Better Maps...

2. NEW MAP FEATURE - DRAGGABLE MARKER

Many of you use the ResortAc.com map feature to show off the ideal location of your rental homes. We use Google Maps for this feature and, in some neighboorhoods, the marker showing the location of your home appears in the wrong spot on the map.

We now offer the ability to drag the map marker to the exact location of your rental home. Please take a minute or two to make sure the  map marker on your listing is accurate.

Here's how to check your map... 

  1. Logon to your ResortAc.com account, then click on the property you want to check out.
  2. Scroll down to the map settings and click the 'View Map Now' button.
  3. A new window will open up where you can type in your address, then save your changes.
  4. The map with marker will appear. If the marker is in the correct spot, you are good to go.
  5. If your marker is in the wrong spot, click on the marker, hold your mouse button down, drag to where you want the marker, then release your mouse button.
  6. Once the marker is in the desired position on the map, save your changes by clicking the 'Save Marker' button.

1. HOW TO MAXIMIZE YOUR WHISTLER RESERVATIONS - 3 EASY TIPS

The most frequent complaint we hear from potential renters who visit our website is... "WHY DON'T OWNERS UPDATE THEIR LISTINGS?" Please help me fix this problem today!

With predictions that 2008-09 winter business will be down, we need to showcase your Whistler vacation rentals effectively. Updating your listing is a great start.

3. TOURISM WHISTLER SOUNDS WARNING

Economic downturn expected to impact Whistler, but there are bright spots, by Andrew Mitchell... Pique Newsmagazine

Tourism Whistler president Barrett Fisher didn’t sugar coat the possible impacts of the economic meltdown at Tourism Whistler’s all-members meeting on Oct. 9, but called on the association’s partners in the resort to work together to meet the challenge.

“We have some tough times ahead, it’s been doom and gloom on the market side, but we have a choice,” she said. “We can either recognize that and adapt our strategies, or we can do nothing and follow (the market).

“The U.S. market decline is nothing new,” she added, “it really started back in 2007 (with the subprime mortgage issue).”

Tourism Whistler released several scenarios for the coming winter season. The worst-case scenario, based on Tourism Whistler’s long-term forecast and conversations with agents, is an overall 12 per cent drop in visitors this season compared to last. Even the best-case scenario, with the resort taking several steps recommended by Tourism Whistler, will result in a five per cent drop. Given the scope of the financial crisis, Fisher said, Whistler is in a better position than other resorts because of a superior product, reputation, location, and the additional attention the resort community will receive as a result of the Olympic Games, Olympic test events and initiatives like the Peak 2 Peak gondola.

“If we do nothing, we’ll be down 12 per cent,” she said. “If we work at it, maybe we’ll see a drop of nine per cent. If we really come together as a resort, if we co-operate, think strategically and look at prices and… act on the opportunities we could potentially be looking at a better case scenario of five per cent.”

Arlene Schieven, vice president of marketing, said we can expect the coming winter to be similar to the 2004-05 winter season, when the lack of snow in January and February kept visitors away. As well, she noted that the decline started last winter as the number of paid room nights dropped one per cent in February and March after a strong start to the season in December and early January.

While most markets appear to be trending downward, Schieven expects the regional market to be down slightly this season but otherwise strong and recommended a renewed focus on the Lower Mainland and Washington State.

Most foreign markets, including the U.S. and U.K. are expected to decline. The exception is Germany, where an increase is expected, partially because of the Olympics and the test events taking place at Olympic venues this winter. Australia was also poised for growth, but Tourism Whistler is cautious about their forecast given the recent drop in value of the Australian dollar.

Tourism Whistler also did a survey of Washington and California visitors last season, and found that roughly a third were planning to take fewer trips, and a third were taking less expensive trips. “About 25 to 30 per cent said (the economy) wouldn’t affect them, but we need more than that,” she said.

Karen Goodwin, director of sales, also gave a presentation. Goodwin lamented the fact that 25 airlines went under last year, including Zoom Airlines which represents 15,000 seats to B.C. (far less than the 50,000 quoted in a previous article). As well, she quoted a study that found that up to 30 more airlines will go out of business this year.

“It may not affect us directly, but it affects confidence,” she said. “When XL Airline went under three weeks ago, they stranded 60,000 people.”

In addition, fewer flights from the U.S., Toronto, and Japan will be landing at Vancouver International Airport because of the costs involved. Comparatively, Goodwin said it costs airlines about twice as much to fly into to Vancouver as it does to fly to Colorado.

Diana Lyons, vice president of operations, also presented the results of her telephone surveys with booking agents around the world. The results of those surveys are confidential, but most agents expect drops in the double digits.

She also noted that there were a half million empty rooms in the first three months of 2008, and that the drop predicted will add another 100,000 empty rooms to the total. As well, Whistler’s average daily rate for rooms was creeping up in the past year, and she said that accommodation providers were pricing themselves out of the market.

“The average is over $300, which is a big concern for us… and we’re also seeing the length of stay decline,” she said. She noted that many accommodation providers in other resorts are providing discounts of 25 to 30 per cent to agents and package deals, while local accommodation partners are offering a 10 to 15 per cent.

With the bad news out on the table, Tourism Whistler announced its strategies for dealing with the economic downturn. For Schieven, that means refocusing marketing spending on locations where there was a high rate of return last year and on the regional market.

When asked how Whistler could compete with other B.C. resorts that are vying for the same regional market, she said that because of its location Whistler does a better job attracting two- to three-day visitors than other resorts who typically do better attracting guests for five to seven days. She also pointed to packages being offered to the local market, including a two nights for under $200 program.

Tourism Whistler has booked a 30-second commercial that will be on Outdoor Life Network and other channels, magazine ads in the mainstream publications (partnering with Whistler-Blackcomb to promote Peak 2 Peak), and newspaper ads in targeted cities like Vancouver, Toronto, Los Angeles, and Sydney, Australia, as well as in Canada’s national newspapers.

Lyons talked about Whistler’s promotions for the coming season, including the Book Early and Save campaign that lets visitors save up to 35 per cent. The closing date for the promotion is Nov. 15, but if bookings are slow the date may be extended to Nov. 30.

Lyons also recommended that local accommodation providers form partnerships with groups offering last minute deals and promotions, which present an opportunity for high-end hotels to offer lower rates while protecting their brands.

As well, she said that agents should focus on value, as well as the big mountain experience, the new Peak 2 Peak Gondola, the favourable exchange rates for American visitors, lower gas prices, and the family holiday experience.

She also identified some obstacles to Whistler travel. For one, she recommended that some hotels change their deposit and cancellation policy to allow last minute cancellations. “It’s better to book them and to take the risk than it is not to book them in at all (because they’re scared of losing their deposit),” she said.

She also advised accommodation partners to look at their minimum length of stay requirements. Hotels should still protect their weekends, she said, but accommodation providers should also be flexible for mid-week bookings.

As well, she advised hotels to look closely at their pricing from day to day, and urged them to try and be consistent. “It’s confusing customers who don’t understand why there’s a price change from Tuesday to Thursday,” she said.

She also urged the food and beverage industry, and retail industry, to get involved with packages. One area where Whistler comes up short compared to sun resorts and winter destinations in Europe is that we don’t have an all-inclusive option for lower income travelers.

Goodwin further recommended that Whistler keep price parity with other ski resorts that are already lowering their prices in response to the economic crisis.

Fisher cautioned that Tourism Whistler’s forecast is based on older data, and that the economic crisis is still unfolding. “We don’t know what all the impacts are going to be,” she said. “But at the end of the day, I’d still rather be us than other resorts.”

We have seen a recent surge in scam attempts in Whistler over the past week. Be aware of the overpay-and-get-refund trick that is being used by fraudulent renters. Here is an email recently received on ResortAc.com:

Scam Alert

4. SCAM ALERT - OVERPAYING, REFUNDING

A common scam occurring in the owner-direct vacation rental world, recently, is the overpayment-and-request-refund scam. Here's how it works...

For whatever reason given, the potential renter wants to send you a check for a large sum of money in excess of the rent due. They may give one of the following reasons why they have this "suspiciously large" check to send: wedding gift, honeymoon, payment from a trust fund, bonus from their employer, or gift of another type. If you deposit this check they will ask you to wire the difference back to them immediately. You may be hounded and possibly threatened to return the excess funds. Here's an example from a recent Whistler rental inquiry:

New Photos?

6. CALL FOR PROPERTY PHOTOS AND DESCRIPTIONS

As the operator of this website, the most common question I am asked is 'how can I get more inquiries and bookings?'. The obvious answer to me is to offer the most desirable image of your property, using pictures and words.

You've heard it before, but a picture is worth a thousand words. Whistler vacation rentals are a cut above typical ski resort accommodations, so why not let your potential guests see for themselves? It's fast and easy to load photos directly to your listing 24/7. In this day of digital cameras, there's no excuse for outdated, fuzzy or dark photos.

Once you've taken care of your photos, you need to check your property description. On our site you have unlimited space for describing your rental homes... take advantage of it! Provide details about your favorite features, location, and surroundings. If you spend time in Whistler yourself, think about the 'experience' your home provides and convey this in your description.

It's a great practice to have a few friends or co-workers critique your listing after you've given it a facelift. You may be surprised how many important details you've overlooked... not to mention grammar and spelling mistakes! Remember, there are literally hundreds of owners and management companies competing with you and the potential customer will judge your home (and you) based on your listing details. It doesn't cost any extra to put your best image forward... and you may be pleasantly surprised with the results!

We have been drifting this way for the past couple seasons, but it seems like the hoteliers are in full swing now. I know I was.

3. LEVERAGING YOUR LISTINGS WITH COLOR POSTCARDS

In marketing our own rental property, we've found that a picture postcard can be extraordinarily effective. We recommend them to all of our readers. Here's why.

First, a postcard with a beautiful picture on the front isn't going to be tossed in the trash. It's just human nature for someone to turn it over to see what's on the back.

Second, who usually sends postcards? Friends and family, of course. So your recipients will be predisposed to look at them.

Third, standard 4.25- by 6-inch, four-color postcards are incredibly inexpensive. For less than $140, for example, you can have 500 color postcards printed, front and back, and delivered to your door. That's a cost of about 28 cents each. (The unit cost drops with the quantity ordered, of course.)

Best of all, a postcard makes it easy to leverage your online property listings. Just have the printing company include not only your land address and telephone number, but also one or more addresses for your online listings.

Once you've got your postcards, you'll want to mail them to all of your former guests as a warm gesture and gentle reminder. (Scribble a quick note on the back to the effect that you hope to hear from them about renting your place again this season.)

Keep a supply of postcards in your car so you can pass them out to interested parties. (Think of your postcard as your property's business card.) Also, be sure to stock your vacation property with a supply of postcards for guests to use and send to their friends.

5. WHEN VACATION HOMEOWNERS GO ON VACATION

Yes, it's true, vacation homeowners go on vacation too. As schools let out and the height of the summer getaway season approaches, many of you may be dreaming of your own escape from it all. It might be worth a moment's time, though, to consider how your vacation can affect the renters who are paying you for theirs.

Just yesterday we received a phone call from a frenzied vacationer who had paid their monies, received the key, and successfully navigated to the rental home only to find that the key didn't work. Repeated calls to the owner got only an answering machine ... the owner was on vacation himself. The renter knew there was a caretaker, but had no phone number.

Thus the call to CyberRentals, the only alternative they had. We attempted to help by sending emails and calling various phone numbers, all to no avail. As of this writing the renter is still locked out.

To make sure that your own vacation goes without a glitch, and that you gain the uninterrupted peace and quiet that you so richly deserve, here are a few easy steps to take:

1) Be sure to include any caretakers' phone numbers on each document you send to renters, including leases, maps and directions, etc.
2) If you don't have a caretaker or property manager on call, be sure to have some alternative contact (friend, relative) so that renters in emergency situations have someone to call -- even if that contact can only tell folks where an extra key is hidden on the property.
3) While on vacation, consider modifying your home phone answering machine to include the phone number where you can be reached (for emergency use only of course).
4) If you take a cell phone with you, be sure that your guests are aware of the number.
5) Consider removing your email address from your webpages during the duration of your vacation, unless you plan to religiously monitor your email.
6) Be sure to have at least one key hidden on the property for extreme emergency use.
7) Give alternative phone numbers to your vacation rental site. We don't mind recording that info as it can be a lifesaver when we field those rare but horrific calls from stranded renters.

A little bit of forethought can insure that your renters and you both have a terrific, relaxing and hassle-free vacation.

Check-out Checklist

6. FINE TUNE YOUR CHECK-OUT CHECKLIST

Be sure that your vacation rental guests know exactly what's expected of them at check-out. Start a "check-out checklist" by recording a detailed list of what you do personally at check-out. Then reduce your list to a much shorter one that's reasonable to expect from renters rushing to depart.

Be sure that your list is reasonable; happy guests can be a great source of future referrals. Email your check-out checklist to your renters before they arrive. Also leave a printed copy in plain view inside your rental. This helps to make it clear, from the beginning of their stay, that you expect your guests to treat your vacation home with care.

Renters appreciate the checklist because it defines what you expect of them. Here are some basics that we expect to find on a check-out checklist:

__ Dishwashing instructions. (Reasonable: "Load and start the dishwasher before you leave.")
__ What to do with used bed linens, bath towels, etc. (Reasonable: "Place used linens on top of the washer.")
__ What to do with leftover food. (Should unopened food be discarded with the garbage?)
__ Where/how to dispose of garbage.
__ If guests are responsible for any housecleaning chores, be specific -- but never expect your guests to eliminate the need for a thorough, professional housecleaning.
__ Identify appliances that should be unplugged for safety, like the coffeemaker and toaster.
__ Heating/cooling system instructions.
__ Turn off all lights, radios, TVs, and electronics.
__ Instructions for pool, pool heat, and spa.
__ Instructions for safe disposal of fireplace ashes.
__ Instructions for locking/securing your property.
__ What to do with the keys.
__ How to report destroyed, damaged, or lost items.

Your checklist should also address any financial issues:

__ Tell guests when to expect return of their security deposit; identify possible "deductions". Be specific to avoid misunderstandings, bad feelings, and complaints.

Government of Canada Gears Up to Put Fuel-Cell Technologies on the Road. World's first Hydrogen Highway to be built between Vancouver and Whistler.

Marking another milestone on the road to a new energy era powered by hydrogen, the Government of Canada today announced funding for the world's first Hydrogen Highway(TM) to be built between Vancouver and Whistler, British Columbia. 9. CHASING THE ALMIGHTY DESTINATION VISITOR

Whistler's business woes were well documented last week [mid-winter 2003/04], locally and in Vancouver, but if it's any consolation, we are not alone.

The City of Aspen is putting $400,000 into helping the Aspen Skiing Company subsidize hosting the X Games over the next four years, the X Games being the biggest marketing boost Aspen has seen in years. The city is also working on a downtown revitalization plan. Last month Colorado Ski Country USA, the marketing arm of all Colorado ski areas, announced skier visits for the first period (Oct. 28-Dec. 31, 2003) were down about nine per cent from the same period last year.

Earlier this winter a study commissioned by Colorado ski areas found the state had lost 1.23 million destination skier visits over the last six years.

Interestingly, these random economic indicators come after record skier visits last winter in both Canada and the United States. The winter of 2002-03 produced generally good ski conditions all season, all across the continent. The suspicion is that the record skier visits were fuelled by regional skiers and boarders who decided to visit their local mountain more often.

So, are regional skiers the new/old market North American ski resorts must rely on? And if so, does it make sense that B.C. has a new Ministry of Resort Development?

To be sure, the new ministry is not just about facilitating the development of mountain resorts. And even if the regional skier market seems to be what ski areas across the continent are focussing on right now, that doesn't mean destination markets won't return or new ones won't develop in the future.

But at the same time, it appears that the ski industry and the province are taking their cue from the sausage industry: the finished products, the ski resorts, certainly look nice, but maybe there should be more focus on the raw materials that go into them.

The foundation of the business - the raw material - is what we now call the regional market. It used to just be called local skiers.

Many years ago, before skiing became a business, it was a recreational pursuit, usually a family activity, and often part of a town's culture. In the Interior, ski areas at Kimberley, Rossland/Trail, Nelson and other areas developed from the mining industry, which was the industry in those towns. Skiing was what much of these towns' folk did on weekends and in their spare time during the winter. The mining company helped build the lifts and local ski clubs operated them.

Eventually, ski hills began to outgrow the ski club model and became businesses. But as the ski business grew it became, in many people's minds and wallets, more exclusive. Today those in the ski hill business are left trying to steal destination visitors from one another while hoping the regional market can sustain them.

The ski business has also morphed into the resort industry, with mountain villages and a cadre of little businesses dependent on the overall success of the resort - this newspaper being one of those little businesses.

Because this model has been mostly successful, we now have a Ministry of Resort Development. That's not necessarily wrong - as Al Raine has said, if we set our minds to it, there's no reason why B.C. can't become the number one jurisdiction for winter sports in North America. I'm just not sure if we've made that decision and if so, if we know why we're doing it.

We've wandered far from the roots of the sport. It's now something people must invest in, something too many people have to be convinced to do, rather than something that people grew up with.

About three years ago John MacLachlan Gray wrote about his family's vacation in Whistler. Gray, who feigns no interest in skiing, wrote:

"I understand the thrill of skiing has to do with cold clean air, immense vistas and the sensation of speed; but cold air and immense vistas are a Canadian commonplace, and I have enough speed in my life, thanks. Did the year 2000 go by fast enough for you? Enjoying the downhill slope of your physical condition? Is your hair collecting snow?

"There, you see? You're skiing already."

Facilitating the development and expansion of resorts is fine, but efforts also need to be focused on people like Mr. Gray.

Then, perhaps, the regional business will be enough to sustain resorts.

Pricing Errors

We have received a handful of emails and calls from potential renters who feel they have been tricked by our website.  The complaints are due to cheaper prices posted on your availability calendars than what you actually charge.

Renters are shopping for winter 2004/2005 now.  Please check your posted rates to ensure they are correct.

The www.ResortAc.com system automatically adds pricing and minimum nights to your listing using your 'default' values.  If your 'defaults' are not correct for all seasons you are required to logon as the owner and update the incorrect rates / minimum nights on a regular basis.

WHAT'S THE SECRET TO WEBSITE MARKETING?
PART 2: FINDING GOOD KEYWORDS

Here's the next instalment of my 1-minute Web marketing tips.  This is a continuation of Website Marketing Part 1.

Keywords:
If you want your website to be listed by search engines, it must be built around words that your potential clients search frequently.  Similar to the foundation of a house, these sought after keywords should make the solid base for all of your headings, body text, and meta tags. 

There are many tools on the Internet that help you to figure out which words (keyword phrases) to use. My favourite keyword research tools are:

Overture.com - allows you to search for a keyword (i.e. Whistler) or a keyword phrase (i.e. Whistler accommodation).  Simply enter the keyword(s) then instantly view a report showing how many searches were processed on Overture during the past month.

WordTracker.com - allows you to enter some keywords then tells you how often people search for them on a variety of search engines.  Also tells you how many competing sites use those same keywords.

By using these two free tools you can quickly figure out the best keywords to build your website around.  From there it's up to you to include the little gems on each of your web pages.

Owner Tips

MAKING YOUR GUESTS FEEL WELCOME

I am sure that as vacation property owners, we all have our own ways of making our guests feel welcome. First, and foremost is being nice, polite and professional. People respond to people they like, and that is how we probably got the rental over our competition in the first place.

I have several things that I do in order to stand out, and hopefully gain repeat and referral business. First of all, I have what I term a packet of information that I send each guest after receiving their deposit. In it, I make sure to include my brochure, and I have a four (or five page for our other condo) page list of activities and attractions that I put together especially for our guests. This gives your guests some good information to look forward to receiving right away. It doesn't cost anything except some time. Make sure you give yourself credit, and include your name, phone, address and email address at the top.

When our guests enter our vacation homes, they will find some pleasant surprises. I vary what I do depending on our guests. If we have a couple celebrating an anniversary, I make sure to include a bottle of wine, or sparking cider which is enclosed in a pretty fabric gift bag. I make sure that every guest receives a small fabric gift bag that I fill with my business card, an individual bubble bath pillow packet, and either scented bath salts or tub tea. Our housekeepers usually leave this on the bed, or you can place these items in a small basket in a bathroom like other owners I know of. For repeat guests, or as a special for our one property in off season, I offer a complementary bath and body basket. I buy these items in bulk, and offer most of them for sale on my website.

Here is another great idea from a very nice owner who recently emailed me. This is one unique touch Marie offers. "Thought I would share something I do for my Guests after final payment is received along with the info packet I mail to them, I print them out calling cards with their names (The Smith Family) rental dates, the address and the rental phone number. I print out a sheet for each rental, that gives them 10 cards to share with family and friends. They often comment how much they appreciate that little touch. A great "bang" for a few cents and 5 minutes of my time." Thank you again Marie for sharing!

EASY WAYS TO INCREASE BOOKINGS

Maximize your booking opportunities by staying on top of your inquiries! Check your email and phone messages frequently - at least once a day, if not more. The sooner you receive an inquiry and respond, the more likely you are to be the first owner the inquirer hears back from. This gives you an advantage over other properties as the vacationer will be impressed and pleased by your quick response, and may even book right away. While it is not always convenient to respond immediately, you can make it easier to do so by minimizing the steps involved in making a response. If you regularly get asked the same questions when people inquire, compile a friendly "frequently asked questions" that you can send as an email attachment along with a personal greeting thanking them for their inquiry and answering any other questions they may have which are not on the FAQ.

If you send additional information through the mail, assemble information packets in advance, so that you simply address them and drop them in a mailbox when an inquiry is made. In all cases, keep your property information at your fingertips, especially up-to-date availability information (if more than one person handles bookings, be sure to
communicate changes in availability as soon as dates are filled!).

Vacationers will appreciate your efficiency, giving them confidence in you and your rental. All amenities being equal, this confidence could be the deciding factor in
booking your property over another. It is also a good idea to keep track of inquiries you have responded to, including the dates of correspondence. This way, you can easily follow up with people who don't get back with you after your response. They may have lost your information, or become busy and neglected vacation planning. Follow-ups remind them of your property and give you another opportunity to connect with them, answer questions, and ultimately secure a booking. Logging the final outcome of communication is also very helpful. A review of past inquiries and bookings can give valuable information about types of people who inquire and book your property and can help you make your advertising materials more effective by targeting those groups of people.

Listings that Sell

Online Listings That Sell! Planning Your Pix

In the last issue, we looked at writing property descriptions that projected a real personality. This time, we'll focus on photos.

As wordsmiths, we'd love to believe that photos merely illustrate the text in online property listings. But we know that it's really the other way around. People look at the photos first, and only if they are intrigued do they read the text. In our opinion, both text and pictures must complement each other, and both must be superb. But a picture really is worth a thousand words, and a really good picture is worth thousands of words more.

Don't use just any photos of your vacation rental property. Instead, decide that you need the equivalent of the photos a real estate agent would commission if your property were to
be for sale. That's Step 1.

Step 2 is to assume that you can display an unlimited number of pictures of your place. In reality, most Web sites let you display three or four pix as part of your basic subscription, but you can usually opt to display more for an additional fee. (And on some systems, buying more photos can give you greater prominence in a prospective renter's search results. But that's a topic for another issue.)

Step 3 is to prioritize. Assume that you must select only three or four subjects for photographs. What would they be? Keep in mind that your audience is prospective renters. So what does your place offer that they really, really want?

Step 4 is to either hire a professional photographer or to bear down and think about how you will take the photos yourself. Plan to shoot the absolutely essential images that are at the top of your list, as well as the scenes or images that you deem less essential. These "less essential" images can be added to your listing later (for an extra fee), or used for a Web page devoted to your property that you might create in the future.

Step 5 is to "dress the set." Professional photographers know all about F-stops, lighting, and film speeds -- or their digital camera equivalents. But you can't expect them to know what a given image should contain. If a picture of your property's great room is going to have a vase of fresh flowers in the frame, you must put them there. You can't expect a professional photographer to do so for you.

Finally, if you use a professional photographer, make sure that he or she gives you digital copies of all of the shots taken. Probably on a CD, probably in JPG/JPEG or TIFF format. Having your images in digital format will make your life much simpler.

Banner Idea...

A BANNER IDEA

It’s difficult not to miss the 3,000 square foot banner that’s now hanging off the scaffolding of the Westbrook hotel, which is currently under renovation.

But what might not be so obvious is the departure from the municipality’s old bylaws hanging this banner represents.

In the past this type of thing would have been impossible.

However, the municipality realized earlier this summer that steps had to be taken to protect the visual image of the resort during heavy construction periods and hanging banners was one way to accomplish that.

"It was in response to concerns expressed by local businesses," said Mike Kirkegaard, the senior planner for the RMOW. 

"They’re having a tough year, and construction in Whistler has a significant impact on the visual appearance of the town.

"The new guidelines for construction site management…are to make the sites as aesthetically pleasing as possible."

There are guidelines as to how big sponsor logos can be, and banners will be held to an artistic standard.

The Blake Jorgensen picture on the Westbrook was selected by municipal staff and Westbrook management from more than 14 submissions by local photographers. 

The banner, which celebrates the Whistler Summer Gravity Festival, was paid for by the sponsors and the municipality out of the Village Enhancement Fund and a fund for special events. 

The banners are widely used in Europe, and have been recently appearing in Vancouver

While none of the trees being burned represent merchantable stands of timber, officials feel it’s important to stop or slow the beetles’ advance because thousands of dead, standing or fallen trees could make an ideal fuel source for any fire that gets started in the forest. Such a fire would represent a serious hazard to homes and other buildings in Whistler...

BC Rail...

PASSENGERS PART OF BC RAIL'S FUTURE

A future B.C. Rail operator must have a plan for the inclusion of passenger rail and must keep the North Vancouver-to-Squamish portion of the railway’s tracks open, B.C.’s Transportation Minister said this week.

In announcing the names of four firms still competing for the right to operate the Crown-owned railway, Judith Reid said those submitting requests for proposals (RFPs) were required to make provision for a passenger component — which leaves the door open to future rail service linking Vancouver and Whistler.

“Nobody was short-listed if they didn’t include that (passenger) as a component for inclusion on B.C. Rail lines,” Reid said in a conference call on Monday.

Asked about rumours that a future operator — now narrowed to either Canadian Pacific (CP), Canadian National (CN), U.S.-based Omnitrax and RailAmerica — might close the Vancouver-to-Squamish section, Reid was unequivocal.

“They won’t have that option,” Reid said. “The main line from Vancouver up to Squamish is integral to what’s being proposed.”

Reid labeled as “fearmongering” reports which have suggested the company chosen to operate B.C. Rail is likely to slash a large percentage of the railway’s work force.

“There have already been efficiencies at B.C. Rail that have been taken into account in these discussions,” she said. 

“The fearmongering that has taken place has, I believe, been irresponsible, not at all factual, and I believe there is going to be a positive outcome to this process.”

In the past, Reid has stressed that only the operation of the railway, not the tracks and railbed, is for sale. 

The bids are being handled by a four-member evaluation committee, including two B.C. Rail executives and two government officials. Reid said that if all goes well, a deal might be completed by late this year.

I am enquiring about renting a villa/townhouse's which are fully equipped, eg, kitchen, bathroom, washer, dryer, tv. 3 girls (myself and 2 friends) are looking to rent in Whistler from Jan 23 until April 30 2004. Do you have anything available and how much? Either a 1 bedroom or studio depending on the cost, we will be working and skiing for the 3 months.

We are 3 Australian girls on our late 20's who are coming over to Whistler for 3 months to Snowboard and work. We all have permanent jobs here in Australia working for the Government.

CONCERN ABOUT FIRST NATIONS CENTRE PROMPT PUBLIC HEARING EXTENSION

Residents in the upscale hotel/condos along Blackcomb Way are worried about their westerly views of forested parkland if a First Nations cultural centre forges ahead on the Benchlands.

"Our main opposition is to rezoning parkland in the core of Whistler," said local homeowner Elizabeth Yung at Monday night’s public hearing before council.

Yung owns a condo in Le Chamois on Blackcomb Way. Across the road the municipality is considering rezoning a five-acre parcel of forested land to allow for the development of a 45,000 square foot cultural centre. The centre would celebrate the history and traditions of the area’s First Nations.

"Personally we’re very much in favour of having a First Nations centre... but it might not be an ideal location," said Yung.

The strata chair of Le Chamois, Carroll Nelson, also spoke out about losing the forested land.

"It is parkland for us," she said of the land opposite the Fairmont Chateau Whistler at the corner of Blackcomb Way and the eastern end of Lorimer Road.

"A lot of owners purchased their units with the knowledge that was going to stay that way."

In addition to the handful of homeowners who spoke at the meeting, council was also presented with a thick stack of roughly 50 letters from Blackcomb Way residents expressing concerns. Most of the form letters repeated the same concerns voiced at the public hearing.

Robert Blake of the Glacier Lodge Strata Council said he bought his unit on Blackcomb Way on the assumption that the land across the street would remain a parkland.

"This area is beautiful just the way it is," he wrote in a letter dated April 4.

"It is a perfectly wonderful walk and hiking area with natural beauty, which will be destroyed with the addition of this proposed monstrosity."

But in his initial presentation of the cultural centre to council over one month ago, Bob MacPherson, the RMOW interim general manager of planning and development, said that the site was slated at one time for a townhouse development.

"Kudos to previous councils for not letting that happen," he said.

To ease some of the residents’ concerns about losing the parkland, the centre’s architect also spoke at the public hearing.

"The concept is the building is the gateway to the forest and you keep the forest as a park," said Alfred Waugh, of Waugh + Busby Architects.

A partial council moved forward with the newest land development project in Whistler at Monday’s council meeting, despite heavy opposition from one councillor...

"This is a significant change in the future of Whistler," said Councillor Ken Melamed, adding that this is a very contentious land deal...

...[the developer] has asked council to rezone three tracts of land for the Nita Lake Lodge project. They are in brief:

  • a three acre parcel of land at the end of Lake Placid Road for an 80-room boutique lodge and a brand new multi-million dollar train station;
  • an adjoining 23-acre piece of land on the west side of the railway tracks for 14 single family homes and 40 townhouse style employee housing units and;
  • 27 acres of Alpha Creek wetland, located north-west of Function Junction. This site would then be subdivided into 25 acres for preservation and the two remaining acres, bordering Alta Lake Road, will have apartment style buildings with 22 employee housing units...

RENOVATED CONFERENCE CENTRE ATTRACTING NEW BUSINESS

With the renovation and increased capacity of the Whistler Conference Centre – scheduled to re-open in August – Tourism Whistler has been able to attract conferences that previously may not have come to Whistler.

Some of the new business includes:

Federation of Canadian Municipalities — This Canadian association has agreed to host its annual conference of 1,600 delegates in Whistler in May 2009. The group translates into 8,000-plus room nights and will pump more than $2 million into the Whistler economy. With the assistance and financial support of the RMOW, Whistler is going to reap the benefits of this wonderful piece of business.

International Carbohydrate Symposium — Tourism Whistler has gone to contract with this B.C. group coming to Whistler in July 2006. The international conference will bring in 800 scientists for over six nights representing 4,800 room nights and an economic impact over $1 million.

Keystone Symposia — as a result of our expansion we can now accommodate this continued medical education organization that holds many meetings over the period of a year. In the past, Whistler had been too small for the majority of their meetings, however, now we can accommodate the larger groups – the first one arriving April 2004 with 5,600 room nights and an economic impact of over $2 million.

ASIAN PESTICIDES TURNING UP IN LOCAL LAKES

An Environment Canada researcher made a startling discovery in two of Whistler’s biggest lakes – the presence of toxaphene, a toxic insecticide that has never been licensed for used in Canada, and was banned in the United States more than 20 years ago.

Biologist Patrick Shaw made that discovery and others in a study of rainbow trout fat cells from 18 different lakes that drain into the Georgia Basin. Five of the lakes were on Vancouver Island, and four more were in the Lower Mainland. The other lakes were located in remote areas along the coast as far north as Powell River, and about halfway up the Fraser Valley.

The two Whistler lakes in the study, Cheakamus Lake and Garibaldi Lake, showed the highest concentrations of toxaphene, plus the presence of other toxins like PCBs and DDT.

Health Canada has not established safe consumption levels for toxaphene because it’s not supposed to be here, but Shaw believes that the levels he detected were significantly higher than Health Canada’s alert levels.

"With the absence of guideline levels, Health Canada alert levels are typically about 10 nanograms per gram of tissue," says Shaw. "In most lakes around B.C. we would find levels of about five nanograms per gram of tissue, but in Garibaldi (and Cheakamus lakes) the level is about 160 nanograms.

"The numbers we got wouldn’t prevent me from eating a few fish out of the lakes up there now and then, but they were surprisingly high."

According to Shaw, the real risk arises from a process known as bioaccumulation. Predators that live off of fish that have concentrations of toxins, such as bald eagles, osprey and minks, will rapidly accumulate dangerous levels of the toxins in their bodies. At every stage of the food chain, the accumulation of toxins is more pronounced.

MELAMED FINDS FAULT WITH NON-COST HOUSING INITIATIVES

In the final hour of Monday’s marathon meeting Councillor Ken Melamed withdrew his support of the municipality’s non-cost housing initiatives, saying the bylaws did not give the municipality enough power.

"This can’t be the standard because it’s going forward on the weakest foot," said Melamed.

"It is with great regret that I have to vote against this. Too much of this is based on the assumption that the suites will be rented. I can’t move forward on a false assumption."

Municipal staff and a public task force developed the non-cost housing initiatives earlier this year to stop the ever-quickening erosion of employee suites in the resort.

Melamed’s concern is that the non-coast initiatives will allow homeowners to create employee suites but the municipality will have no assurances that these suites will in turn be rented to employees.

I am looking to rent a 3/4-bedroom place in Whistler or the surrounding area with my boyfriend and three other friends. We are planning to stay in Whistler for 4/5 months from mid November 2003. As this is the only house we have found so far, we would like to make some comparisons on location and price with other places.

Welcome to the eleventh edition of our newsletter.  My name is Troy Assaly and I have been operating a thriving owner-direct vacation rental website in Whistler Resort for the past 6 years.

Great Skiing... 

GREAT GROOMERS - GREAT SLIDING

Over the years I've been know to complain about Intrawest on occasion, but this year they have really impressed me by going the extra mile in many respects; specifically grooming.  

My wife Sheila and I were up on Whistler ripping up the corduroy all day Friday, January 17th.  AMAZING!  We started with the 2 for 1 Fresh Tracks Breakfast offered to season pass holders by uploading the gondola at 7:30 am.

From the top of the Peak Chair (Whistler Bowl was groomed!!) all the way to Dusty's and the Village, we carved up untracked groomed runs for hours.  No lift lines to be seen and wall-to-wall corduroy with just enough sunshine.  Did I say AMAZING!

The Village and the mountains are relatively quiet this January, so come on up and enjoy the snow while you can.  By the way, the forecast calls for 15 to 30 cm snowfall Wednesday, January 22nd.

DELAYS, CLOSURES FOR HWY 99 DRIVERS

Funding finally granted for Culliton Creek to Cheakamus Canyon upgrades - www.PiqueNewsmagazine.com - by Alison Taylor

Sea to Sky drivers travelling south of Whistler will have to plan their road trips in advance for the next year and a half or face highway delays of up to 30 minutes.

In just over three months the long-awaited road work is set to begin on the treacherous seven kilometre stretch of blacktop between Culliton Creek and the Cheakamus Canyon.

Although the construction will ultimately improve future driving conditions with the addition of a third lane for the uphill sections, there will be delays and closures while crews blast rock from the high walls that confine the narrow section of highway.

"The message is going to be that we’re doing everything humanly possible to impact as few people as possible," said Dan Mayberry, stakeholder liaison for the Sea to Sky project with the Ministry of Transportation.

Mayberry presented the construction schedule, which is designed to fit around the needs of the local community, at Monday’s council meeting.

Until the end of 2004 there will be three 20-minute stoppages on the road four days a week while crews blast rock. Drivers can expect the stoppages each after 9 a.m., noon and 3 p.m. The stoppages will only take place from Monday to Thursday.  Click here for the whole story.

You Need Pictures...

A PICTURE CAN LEAD TO MANY BOOKINGS

How often do we scan a newspaper or magazine for photos and graphics first and then read the copy?! That is why photos are a top priority and is often the sole reason for holding the attention of a vacationer who's scanning the vacation possibilities. This homeowner offers tips for taking great photos that we could all learn from.

Timing is everything. Different times of day will produce different results depending on whether the subject is an interior or exterior shot. Does the living room shoot better with the morning sun or afternoon; will the exterior look better at high noon when the shadows are minimized? Fashion photographers shoot models just after sunrise or before sunset for that direct, golden glow of the low sun. Take photos throughout the day to get the desired affect (digital cameras make this a snap).

Seasons of Change. Use the seasons to your advantage. If you have incredible fall foliage setting; use it. If your home is hidden by trees, an early spring or late fall photo may help. A lakeside cottage is perfect for summer shots and a ski chalet is best conveyed with winter photos. 

What's your angle? Whenever you shoot a room, remember to start wide and then move in for closer shots. Try shooting from the opposite side as well. Photos can be improved by taking the shots from a chair or ladder too. In some cases, a vertical shot will make the statement. "Sell" your rental with some staging. Two wine filled glasses by the hot tub or a vase of flowers on the kitchen table add subtle touches without overdoing it.

A few final tips. A digital camera allows for numerous photos( and some editing) and is well worth the investment to get the perfect shot(s). Avoid too much light by adjusting the blinds. Make sure your image or the flash of the camera is not caught by a mirror. Don't use people as props. Kitchen counters should be uncluttered. Try some room photos with the lights on; others with a flash. Use your home's architecture to "frame" your composition (doorways, posts). Above all, take your time and don't rush; great photos lead to numerous bookings!

WHAT'S THE SECRET TO WEBSITE MARKETING?

If only I had a dollar for every time someone asks me this one!  The answer is difficult to confine to a few paragraphs and is very time-sensitive, but I'll give you my best shot at a 1-minute lesson.

Keywords:
Your site must have words that your potential clients search for littered throughout it.  These keywords must be in your headings, body text, and meta tags.  There are many tools on the Internet that help you to figure out what words to use.  Then it is up to you to include them on each of your web pages.

Links:
Google, the most important search engine in our world, requires that you have at least one incoming link to your site.  That's right, they actually check to make sure you have a link from somebody else's site pointing to your site.  If the site that points to you is a busy site and has related content, Google will give you a higher rank in their search engine results.  If your site does not have any links pointing to it, Google will not include it in their search engine results.

Search Engines & Directories:
In the old days, about 6 months ago, it was possible to drive traffic to your website by submitting your site address (URL) to the free search engines and directories, then waiting a few months.  Well, things are changing fast!  Many of the top search engines and directories are now charging a fee in order to be displayed on their pages.  Some charge a flat fee (Yahoo US$299 per year) and some sell off popular words to the highest bidder (Overture).  It is expected that all search engines and directories will eventually switch to a pay-to-play model in the near future.

Obviously these three items, above, provide a very brief overview.  Simply an appetizer to get you started.  If you are looking for the full meal deal, just do a search on your favourite search engine for "website marketing" or "search engine optimization" and pig out!

UNCERTAIN TIMES FOR RICHEST COMMUNITY IN PROVINCE

"Why should Whistler, the richest community in our province, receive any public funds for facilities average British Columbians will never use?" - David Adam of Vancouver, in a letter to the editor of the Vancouver Sun published Dec. 27, 2002

Mr. Adam's simplistic point of view is something Whistler has faced for years, but it is likely to be raised more frequently in the lead up to the Olympic plebiscite in Vancouver and the IOC vote in July to decide who will host the 2010 Games. Mr. Adam, as you might have guessed, was opposed to the Olympics coming to B.C.

How many people share Mr. Adam's point of view will be significant because it is during the next few months that Whistler is hoping to receive some special consideration from the province, in the form of new financial tools and relief on school taxes.

The new year brought the news that property assessments had skyrocketed again this year; hardly surprising when demand for Whistler property has continued to grow and supply is restricted. We won't know exactly what the impact on school taxes is for rich Whistlerites until the province sets the rate later this year, but last year Whistler paid roughly three quarters of the district's school taxes. And it was not just the wealthy property owners who had to pay into this unbalanced formula. Rents paid on suites and cabins leased by workers also reflected the school tax inequity in the district.

Whistler's proposals to the province for new financial tools - a greater share of the hotel tax, a percentage of the provincial sales tax, or a specific resort sales tax - remain unanswered at present, but the Adam's Philosophy is likely to be a factor in any decision by a provincial government that is playing defence now that the premier has stuck his foot in it.

Not that all Whistler businesses would necessarily welcome the new financial tools either. There is a feeling among some that if the financial tools involve a new tax on top of the PST and GST that it will turn some visitors off of Whistler. If a new tax reduces sales and/or costs business a little more to administer it may be helping the municipality but it's hurting businesses, so the thinking goes.

We might note that many Whistler business owners saw the school taxes on their businesses jump more than 20 per cent last year.

Whistler businesses, and the resort as a whole, are also facing access restrictions - likely for the next five or six years. In mid-April, work on the Culliton Creek-Cheakamus Canyon section of Highway 99 will begin, just 39 years after the old logging road was first paved. Construction will involve 20-minute closures, three times a day, four days a week for nine months of the year. There will also be some night closures. The project is expected to take up to two years, according to the graphs, grids, pie charts and related data presented by the Ministry of Transportation in the ubiquitous PowerPoint presentation.

That takes us to April 2005, when the $600 million upgrade of the highway between Horseshoe Bay and Squamish is expected to commence. That project will involve more highway closures and take three or four more years.

Of course, if Vancouver-Whistler isn't awarded the 2010 Olympics the timing of the major upgrade could be delayed. But for businesses in the richest community in our province the highway restrictions they will face and those they may face mean a little more uncertainty on top of the hefty costs they are being saddled with.

It's not that highway closures are new; people along the Sea to Sky corridor have dealt with them for years. But - and this may be news to Mr. Adam - Whistler is a significant factor in the provincial economy, contributing an estimated $2 billion annually to the provincial economy. That revenue is based largely on businesses providing reliable service.

And it's not just visitors that need to get up and down the highway, it's goods from a myriad of Lower Mainland suppliers and, increasingly, workers commuting.

DEPOSITS AND CLEANING

Homeowner Roxanne Derni shares her experience in renting her condo in Cannes, France.

She collects a $500 reservation deposit that turns into a damage/security deposit once the full amount of the rent is received 30 days prior to arrival. If the condo is re-rented due to a cancellation, a full refund is sent. Keys, directions and a property description sheet are Fed Expressed to the renting party as she is not able to greet the renting party. By keeping to a Saturday to Saturday check-in, check-out strategy, rentals are maximized.

With arrival and departures scheduled for the same day, co-ordinating the cleaning of the condo is paramount. A check-in time of 4 pm and a check-out time of 10 am in most cases allows the cleaning staff time for the turnover. And flexibility with your cleaners and renting parties is key; especially in the case of foreign rentals where train schedules, for example, may not be in synch with check-out times. A spotless rental home and letting all parties know up front minimizes any hassle that may arise.

TA Zoning...

TA ZONING UPDATE

New direction proposed to regulate TA - Pique Newsmagazine November 8 - by Alison Taylor

The municipality is no longer proposing a blanket business license on all Tourist Accommodation zoned properties in Whistler after taking into account a host of community concerns. Instead, staff will review different options to police illegal rentals in Whistler more effectively and efficiently. They will present those options to council in the New Year, said Bill Barratt, general manager of community services for the municipality.

The original proposal, which called for a blanket license for all TA zoned properties in Whistler, met with community opposition last month at an information meeting at Myrtle Philip Community School. Barratt said the blanket license would have made enforcing the bylaw easier by creating a level playing field. But due to the public outcry to the proposal Barratt says they are trying to find another way to tackle the contentious issue.

"Is this going to satisfy the majority of people that seem so upset?" asked Councillor Ted Milner, after Barratt presented the recommendation to council on Monday night. Barratt said getting rid of the blanket license might alleviate some community concerns.

"By not doing the blanket licensing which seemed to be a concern to the tourist accommodation owner, that concern is gone," said Barratt.

Councillor Dave Kirk asked if the community would be allowed to comment again on the revised proposal. Barratt said there would most likely be another public information meeting after staff reviews the present licensing structure.

"It seems like a good example of the municipality revising its draft document after listening to the community's concerns," said Councillor Ken Melamed at Monday's council meeting. Councillor Kristi Wells, who was acting as mayor due to Hugh O'Reilly's conflict of interest on the issue, said this recent development is a true representation of the democratic process.

Meanwhile, as the municipality reviews its options, Barratt said they are continuing to enforce the current zoning bylaw which does not allow for nightly rentals (under 28 days) in non-TA zoned areas. The municipality has been cracking down on illegal renters after winning a B.C. Supreme Court judgement in the Miller/Rivera case. In that case a Prince George couple were renting out their home to co-workers and friends on a short-term basis although their home was not TA zoned. After that decision came down the municipality began cracking down on the bylaw.

'Blanket' licencing off the table - Whistler Question November 13 - by David Burke

Municipal officials are backing away from a provision of their controversial business licencing scheme dealing with short-term accommodation and reviewing the overall scheme with the intention of bringing it back to Council early in the New Year.

Bill Barratt, the Resort Municipality's general manager of community services, on Monday told Council that as a result of input gathered at a public open house on Oct. 5, staff planned to take a proposal to grant the same licence to all properties zoned for tourist accommodation off the table.

"We're not going to blanket licence all the tourist accommodation owners," Barratt said. "There were a number of issues raised related to taxation and the different levels of government. What we heard was a reluctance to blanket all tourist accommodation with a single licence."

Using business licencing as a means of regulating and enforcing zoning bylaws regarding short-term rentals has been controversial from the outset. At the Oct. 5 meeting, some property owners said they worried that treating all TA-zoned properties the same might cause provincial and federal taxation authorities to treat them all as commercial properties, leading to hefty (and in some cases unfair) tax increases for some.

Opponents of the proposed licencing scheme recently posted an anonymous website to disseminate information regarding property-rights issues in Whistler, with a focus on defending what they see as attempts to curtail their rights to use their properties as they wish.

In spite of the latest move, Barratt said the RMOW still plans to pursue business licencing as a regulation and enforcement option.

Unless and until such a scheme is adopted by the new Council, municipal officials will continue to pursue violators of zoning laws by using restraining orders and current licencing bylaws, Barratt said.

Councillor Kristi Wells said citizens shouldn't see the latest move as a change in the general direction the municipality is pursuing on short-term rentals.

"I think this is a good opportunity to ensure people that Council is not changing its policy direction," she said, adding that the RMOW still plans to pursue the business-licencing scheme as a means of enforcement.

Councillor Nicholas Davies said he thought some of the positions taken at the Oct. 5 meeting were "completely off-base, particularly regarding the taxation issues."

He said he hoped those who come to any future public meetings on the issue are better informed about the initiative's intent, suggesting that the RMOW needs to do a better job of clarifying those aims before seeking input.

Save Energy...

COST SAVING ELECTRONIC THERMOSTATS

If you add an automatic thermostat to your vacation rental, you'll save on utility costs. Modern thermostats are all electronic, and let you SAVE different program settings for cooling and heating seasons. Nearly all allow you to reduce or increase the temperature at any time of night and day. Some also differentiate settings for weekends vs. weekdays.

Read the booklet carefully when you install your electronic thermostat, and make the instruction book available to those who don't like your choice of temperature settings -- your guests are on vacation, after all! We use these settings:

Cooling: 72 F daytime, 78 F nighttime.
Heating: 70 F daytime, 68 F nighttime.

Daytime: 7AM - 11PM
Nighttime: 11PM - 7AM

Weekends vs. Weekdays: Same Settings

Once you determine your temperature and time settings, your biggest decision may be what day of the year to (manually) switch from cooling to heating. Most thermostats are simple enough to install yourself by connecting just a few wires, and a very good one should cost you less than US$70.

Instruct your cleaning staff to re-set the thermostat correctly, each time they clean. Be sure to include step by step instructions with both switch settings (fan auto/on, heating/cooling/off) and temperature settings, whenever your cost saving thermostat requires re-programming by your cleaning staff.

GET IT IN WRITING

Rental agreements vary in detail from the most basic to pages of complex legalese. Whichever you choose, you should always use one. It will give you some basic protection, and will spell out an agreement in such a way that there is no ambiguity between you and your renter in terms of what is expected. By the way, your renter will appreciate this too!

There are several key elements that should be in any rental agreement:

  1. Descriptive Information - this should include the location of the property, contact information for the renter, and your contact information, dates and lengths of stay.
  2. Financial Information - including the amount of your rental fee, rental deposit information (how much, and conditions for return of the deposit or if the deposit is applied to the rental amount, etc.), charges for pets, charges for additional guests, cleaning charges (if any), all applicable taxes, and the total amount due including all of the above (we do not want any surprises for the renter here!).
  3. Detailed cancellation policy
  4. Damage policy
  5. Signatures of both parties (you can mail or fax the signature copies back and forth)

You may want to purchase a legal document (found at office supply shops). Of course, it is always a good idea to consult an attorney for specific rules that might apply in your location.

Additional rules and procedures to follow should be posted in the rental home as a reminder of what is expected of the renter.

Welcome to the ninth edition of our newsletter.  My name is Troy Assaly and I have been operating a thriving owner-direct vacation rental website in Whistler Resort for the past 5 years.

After fielding numerous questions from Whistler rental property owners from all over the world , we have decided that there is an information void. Your questions have motivated us to create this monthly newsletter and post it on the Internet for you to read.  

This newsletter will be focused on Whistler Resort's ongoing community issues, travel and tourism trends, property management suggestions, along with tips on how to maximize Internet bookings for your vacation rental homes.

TA Zoning...

TA ZONING UPDATE

The Resort Municipality of Whistler (RMOW) held a public meeting to gather input on the proposed changes to their business licence bylaws.  These changes are in an effort to reduce the number of non-TA-zoned vacation rental transactions occurring in Whistler.  About 100 stakeholders gathered at the local elementary school on October 5th to find out what is going on and provide feedback to the RMOW.

My observations from the meeting are noted below.  In addition, you will find links to newspaper articles and letters to the editor on this topic throughout the newsletter.

  • property owners were not contacted by RMOW by mail or phone, so many property owners were not informed of the proposed changes to the bylaws or the meeting itself.  One property owner from London commented that she believes the RMOW is obligated to inform all TA zoned property owners of the proposed changes, along with the minutes from that day's meeting, by mail.
  • issuing business licences to TA zoned properties could result in a change in class from primary residence / residential to investment property / commercial, resulting in increased taxes and utility rates for owners.
  • the new bylaws may be just as hard (and expensive) to enforce as the existing bylaws.

In my opinion, no changes to the laws will ever stop unlicensed vacation rentals.  Where there's a will, there's a way.  Where there's a market, there's a website... and you can be certain that website will operate from an area beyond the RMOW's legal jurisdiction.


Tax issue casts cloud over meeting

Property owners' and municipal officials' attempts to discuss proposed amendments to Whistler business licence regulations were nearly hijacked last week by those concerned about the proposals' potential impact on taxation-related issues.


In the end, that was only one of many concerns raised by about 100 people who showed up Saturday at Myrtle Philip Community Centre to discuss the Resort Municipality's latest effort to ensure compliance with its regulations regarding short-term rentals, a.k.a. "tourist accommodation."

Municipal officials took the unusual step of scheduling the three-hour public "information session" on a Saturday because a large percentage of those affected have their primary residences outside Whistler.

After municipal officials began laying down the ground rules for the meeting, however, property owner Lorraine Bennett raised a point which she said called into question the legitimacy of the meeting.

The issue, she said, is that by purchasing business licences — as the municipality proposes for vacation property rental, property management and property marketing/rental firms — individuals risk having their properties re-assessed by the B.C. Assessment Authority (BCAA) as commercial properties, whether or not they actually rent out their properties in the short term.

"We have reason to understand that this could result in a 300 per cent increase in your property taxes, which may affect the legitimacy of this forum," Bennett said.

"All you're doing here is putting a scarlet letter on people's homes so that they'll be the subject of (BCAA and) Revenue Canada inquiries, which is a frightening proposition," said lawyer Derek Creighton, who said he was representing friends concerned about the proposal... More...


TA property owners remain skeptical
Fear tax increase under proposed licensing system

Owners of property zoned for tourist accommodation remain sceptical – if not outright hostile – toward the municipality’s plan to address the issue of "illegal" nightly rentals through a licensing system.

Approximately 120 people gathered at Myrtle Philip school Oct. 5 to discuss the municipality’s proposed business regulation and business licence bylaws, but before the meeting could event get underway Lorraine Bennett of the Whistler Homeowners Group raised a point of order.

Bennett, and others over the course of a two and a half hour meeting, challenged a statement on the municipality’s Web site which said the proposed licensing system would not affect property assessments.

Bennett said her group had received a legal opinion the previous night that if the municipality requires legally zoned TA properties to acquire a business licence, as proposed, the B.C. Assessment Authority may reclassify those properties from class 1 (residential) to class 6 (commercial). That would mean taxes on those properties would triple.

Bill Barratt, general manager of community services, admitted that the municipality has no control over provincial matters but maintained that business licences are issued to companies operating out of residential addresses now, and the B.C. Assessment Authority hasn’t questioned the classification of those properties. He also noted that bed and breakfasts and pensions are classified as class 1 properties.

However Barratt did not convince many.

Myself and 3 friends are currently seeking accommodation in Whistler for the 2002/2003 season. We are all recent postgraduates from UK universities and have sufficient savings to pay for budget to mid-range 
accommodation for the entire season without having to rely on employment in Whistler. We are interested in any type of rental accommodation, inns, hostels or condo's that are availale for the entire season.

This is a genuine request for any information or advice you may be able to provide us with regarding any accomodation available from mid November to late May or thereabouts. Information we require would be 
seasonal rates and also geographical whereabouts of the accomodation. We are looking to book accommodation as soon as possible and are able, if necessary, to pay either the full amount upfront or pay a large deposit. Room and bed configurations are not important as long as the accommodation 
is able to sleep 4 adults. We would prefer self-catering facilities but en suite facilities are not necessary.

We are 4 responsible young adults looking to spend a season in the mountains before seeking full-time employment in the UK. We can provide sound, recent working references and also a solid reference from our rental agency in Chamonix, France where three of us spent the 2001/2002 season.

We are looking for a studio or one bed-room suit with kitchen facility to rent for one month (28 to 30 days depending on flight availability on the particular date of rental expiration). We are particularly interested in a ski-in and ski-out condo located in the Upper Village, such as Glacier Lodge, Aspen, Marquise, Marriot etc. I am a University Professor and both my wife and myself are active skiers, and have been to Whistler twice before. Considering the weather and other uncertain elements , I know it might be much more prudent to rent a room on a weekly basis. I attended the public info meeting on Oct. 5, on the TA business licensing scheme that the bylaw department wants to bring in. I sat at the back and listened intently to all the speakers. I was shocked at what could happen if Council approves this scheme, which I don't agree with in the first place and is badly misguided. Several lawyers who are experts on tax and municipal law stood up and expressed their serious concerns. If any of their doomsday scenarios materialized, it would be a horror story to Whistler property owners and the RMOW itself. Here is a summary of what I heard...

Nix 'silly' TA licencing plan

Dear Editor,
I just about came down with a migraine after attending the Saturday information meeting on this TA licencing idea. The possibility that TA property tax assessments could go up 300 per cent is frightening. Most property owners are upset with the current increase in taxes every year, and some are financially stuggling.

I never did like the idea of TA owners being used as a means of helping out the enforcement of non-TA owners through business licencing. I definitely don't like the idea of financially subsidizing City Hall through paying for a licence. Any enforcement costs should come out of general revenue.

To top it all off, the bylaw department said at the meeting that there are maybe only 25-30 non-TA owners "offending." They also categorically stated that the whole purpose of their enforcement actions and this TA licencing proposal were to protect the "financial interests and market share of TA owners." When asked if they if they had checked with all the property management companie s and privately managed TA owners to see if there was any feedback or concern, the bylaw department said that they had not done so.

It seems like the bylaw department is basing their actions on pressure and chronic complaints from three vocal people who were named at the meeting — John Richmond, Margi McGraw and Lina Jacobs...

Revised approach to TA issue needed

Re: Business Regulation and Business Licence Bylaw Amendments public meeting, Oct. 5.

On the evening prior to the public meeting held at Myrtle Philip Community School, it came to our attention that possession of a business licence by TA-zoned homeowners could cause the B.C. Assessment Authority to automatically change the mill rating on our properties from Class 1 to Class 6. This would result in a three-fold increase in our property taxes. We are given to understand, in informal legal consultations, that this is a realistic expectation.

In the RMOW website FAQs regarding the Business Licence Bylaw Amendment, you state: "There is no financial impact and no impact to your property tax assessment or property tax classification." Clearly, the RMOW is making a statement it has no right to make: property tax classifications are determined by the province, not by municipalities. In this matter, the potential impact upon homeowners is not insignificant; it is huge.

In the matter of enforcement of zoning regulations on owners of illegally rented residentially zoned property, resolution via business licensing, as proposed by the RMOW, is plagued by two key issues...

TA enforcement needs a re-think

Firstly, thank you for holding the public information meeting concerning the RMOW's planned bylaw amendments. It was very informative and I hope from the information you gained from it you now realize that issue is not as straightforward as it appears and that in its present form the risks to TA owners are too great to even be considered. 

Secondly this letter is not a personal attack on you as I do believe you have all worked very hard on this, but under the misguided thought that it is going to be good for TA zoned owners. WRONG.

That the B.C. Assessment Authority will not re-assess all TA-zoned properties commercial once they have a business licence is naïve and the RMOW cannot give that reassurance as it is out of their power to do so...

SUN, SUN, SUN AND ALPINE FLOWERS

July is the month of my birthday... that's guaranteed every year.  What's not guaranteed every year is sunshine in Whistler during July.  Well, for those of you who missed it, this July was the sunniest I can remember since arriving in Whistler about 10 years ago.  Hopefully the great weather will carry right on thru August this year.

Word on the street is that the alpine flowers are now in full bloom.  Personally, with the arrival of the new baby, I haven't found the time to get up to Whistler's pristine alpine meadows yet; however, I keep hearing from friends and tourists that this years' bloom is worth the ride to the top of the mountain.  The mountain tops of Whistler and Blackcomb offer great marked hiking trails for all ability levels.  So pack a lunch (or buy it up there) and head on up to 5000 feet for change of scenery!

More Bookings...

WHY AM I NOT GETTING BOOKINGS?

Here are a few pointers from Jan Van Voorhis of Great Rentals...

If you are getting inquiries for your rental property, but don't seem to be getting many bookings, try what we suggested to one satisfied customer:

1. REVIEW YOUR AD CAREFULLY.

  • Are your rates higher that others in your area? Browse vacation rental web sites to compare your rates to others with the same location, number of bedrooms, types of amenities etc., and lower them if they are too high.
  • Are your rates clearly stated? Saying something like "from $700/week" may make potential renters suspicious of the actual price they will pay. (Think about motels that offer rooms "from $39". These rooms never seem to be available when you get there!)
  • Do you state all additional fees on your web page ad? Never surprise a renter with special cleaning fees, or local taxes after he or she arrives. Always let the renter know the total price right at the beginning.
  • Do you display the maximum number of photos allowed by your web site? Do you have one of the view if you advertise a view? Do you have at least one of the interior and one of the exterior? How is the appearance quality of your photos compared to others on the same web site? Would you rent your property based on your photos?
  • Is your description appealing enough to entice people to want to stay at your rental? As long as you are being honest, do not be afraid to 'blow your own horn'!
  • Are you exaggerating the quality of the view, for example, or the distance to the beach. It will affect the quality of the vacation for the renters if they feel cheated. You may get a negative reputation, which can be a difficult thing to reverse.

2. REVIEW YOUR RESPONSE TO INQUIRIES.

  • Do you respond to inquiries right away? Since an inquiry is often sent by a vacationer to many property owners, check your email and phone messages often and respond ASAP. The early bird gets the worm!
  • Do you follow up? After a day of getting no response back from someone who has inquired, follow up with a phone call (if they gave you a phone number), or an email message. Sample phone script: "You inquired about our condo yesterday. Have you found a rental yet?" If yes: "I would be interested in knowing why you chose it over our rental so that I can improve."
  • Do you often ignore inquiries? Try to respond to each inquiry. Even if you could have rented your unit over and over again for Easter, reply suggesting that they try again earlier next year or offer an alternative week.

If you can improve the quality of your ad or your response to inquiries, you may also improve your number of bookings!

Davenport issues challenge to status quo - Pique Newsmagazine July 26st - by Bob Barnett

Municipal elections are four months away but interest in who will lead Whistler after Nov. 16 is already piqued, as more than 140 people gathered at Les Deux Gros Restaurant July 12 to hear Dave Davenport launch his campaign for mayor.

Davenport, who with his partner Lauren Wornig owns the Skitch store and Mountain Crests embroidery, issued a strongly worded challenge to the status quo at municipal hall and asked people to think how Whistler can move forward in relation to four specific "opportunities": confident leadership, financial responsibility, action, and openness.

"My first point is that we can improve the expectations we have for leadership from our mayor," Davenport told the gathering.

"We need a mayor who is prepared to stand up, say what it is that he believes and confidently advance our community. We need strong leadership that understands that there is a great difference between simply trying to find consensus – rather than working hard and actually building consensus.

"We need to rediscover the power that comes from six councillors – driven to work hard – and made to focus on the tasks at hand."...

Government report on benefits of 2010 Winter Olympic Games called into question by B.C.’s finance minister - Pique Newsmagazine July 26st - by Clare Ogilvie

B.C.’s finance minister is questioning the economic boost the province may get from hosting the 2010 Olympic Winter Games.

Quoted in the Vancouver Sun this week, Finance Minister Gary Collins said he was "very nervous" about projections made in January in a government report.

The January report said 228,000 jobs could be created and that over 30 years the Games could generate $10 billion in economic growth.

FREE INFORMATION ON CHALET OWNERS LEGAL RIGHTS AND OPTIONS ON TA RENTALS

We have had many requests for information on the legal rights and remedies of those who own chalets, are not zoned for that type of rental as such, and want to know their options. We are advised that a new free service is now available with that information. The team of people involved in this initiative are Whistler property owners, concerned Whistler citizens, and lawyers who are either property owners in Whistler, or who regularly enjoy Whistler's beauty and many recreational opportunities and spirit. The common purpose is to make Whistler an inclusive and cohesive community. Apparently, a website is scheduled for launch before the end of August, for more thorough and convenient information exchange.

If you are currently renting your chalet for temporary accommodation (short-term rentals), and are interested in the following information being provided to you free of charge, please email to: whistlerjustice@yahoo.com. If you are concerned about confidentiality or privacy, you may prefer to use a hotmail account to maintain anonymity. The information that would be provided to you on a periodic basis (unless you wish to have your contact email removed on request), would include:

  • background to the history of temporary accommodation (short-term rentals, eg. less than 4 consecutive weeks) in Whistler
  • the many flexible rental options that are available
  • your legal rights and remedies if Whistler (RMOW) challenges your right to rent out your chalet for short-term accommodation. Steps to follow if you are contacted by RMOW.
  • how to obtain free initial consultations from experienced lawyers in Vancouver skilled in municipal law ,and familiar with the RMOW bylaw relating to rentals of chalets. Ideally, you would want to have consultations with several lawyers, so that you are comfortable that the advice is consistent, in terms of protecting your many legal and property rights.
  • constructive proposals for change to permit licensing of chalets in non-TA zoned areas. 
  • how you can assist in encouraging City Hall and Council to review the licensing model
  • how you can support candidates running in the November 16 municipal election, who support a more positive, objective, realistic, flexible, balanced, and inclusive licensing model, and who believe that a moratorium on bylaw enforcement against chalet owners in the meantime, is the only responsible, realistic and pragmatic way of changing the present climate. The current system is clearly not working, so finding new, constructive and innovative ways of making the TA system work for chalet owners, the community of Whistler and its guests, is required. In other words, a respectful win/win solution for everyone.

LETTERS RECEIVED BY RESORTAC.COM

I didn't know whether to laugh or cry...

When I read a recent "letter to the editor" from city hall staffer, Bill Barratt, I didn't know whether to laugh or cry. I disagree with every sorry excuse he made to justify his conduct. That is, to pursue chalet owners who were alleged to be contravening a municipal bylaw, by "short-term" rentals. His arguments are specious and superficial, and could not withstand the test of objective scrutiny. Due to space, let me just comment on one of the points he made. I would like to set out my case to debunk the TA myth that Mr. Barratt is attempting to proselytize.

Barratt stated that he "wanted the integrity of the neigbhourhood maintained". A little later in his letter, he stated his actions were designed to "protect our neighbourhoods and quality of life of our residents". Oh really? Emotive stuff, but like most hyperbole, without substance once you scratch beneath the service. Simply designed for impact effect.

Let's look at the myth, the faulty logic, and the reality.

RMOW PULLS ALLURA'S BUSINESS LICENSE

We should have seen this coming.  Just another sign of how Whistler is selling out to big corporations.  Pressure is mounting on Whistler's Staff, Mayor, and Council to stamp out any activities that may affect corporate shareholders' interests.  Being consistent with their decisions of late, the RMOW has sided with the corporate crowd rather than the grass-roots locals again.

While attending the show-cause hearing for AlluraDirect.com at Council Chambers on June 17th, I witnessed how our lawmakers are spending our tax dollars in an effort to shut down a very successful Whistler business. Six Councillors, Lawyers, 6 RMOW Staff, private investigators, newspaper ads to announce the meeting, and a dozen fancy binders with print outs from Allura's website. No expenses were spared in this mini trial.

What a strange time to run a vacation rental business in Whistler.  One day I see Allura getting their business license pulled for advertising and marketing 10 non TA zoned homes, the next day I receive a desperate letter from the 2010 Bid Corporation looking for a commitment on as many rental beds as possible.  It's all makes for very interesting reading.

Company facilitating illegal TAs penalized - Whistler Question June 20th - by David Burke

Whistler Council this week suspended the business licence of an on-line tourist accommodation and reservation service for facilitating the rental of tourist accommodation in residentially zoned properties, contrary to municipal bylaw.

The suspension of AlluraDirect.com's business licence is for three months, but at a show-cause hearing in Council chambers on Monday, municipal officials stressed that the company could reduce the term of the suspension at any time by demonstrating its compliance with the bylaw.

Council — minus Mayor Hugh O'Reilly, who declared himself in conflict because he lives in a neighbourhood zoned for tourist accommodation — voted 5-1 in favour of ordering the suspension on the grounds that advertising rentals, communicating with potential customers and processing payments constituted facilitating the illegal activity.

Councillor Nicholas Davies cast the lone dissenting vote in the quasi-judicial hearing, the first of its kind for the Resort Municipality.

Davies, a lawyer, argued that while the processing of payments certainly constituted facilitating illegal TA rentals, advertising and communicating with customers could well fall under the provisions of Canada's Charter of Rights and Freedoms restricting the abridgment of free speech.

"The Charter of Rights and Freedoms applies here, and in my view, we can't ignore the Charter," Davies said.

We need to be careful that our decision is carefully crafted. Otherwise, we open the door to appeal and open the door to unnecessarily spending taxpayers' dollars."...

Busted - RMOW suspends vacation company’s business licence - Pique Newsmagazine June 21st - by Bob Barnett

The municipality has suspended the business licence of AlluraDirect.com, a Web-based lodging and vacation services company, for facilitating the rental of residentially zoned properties on a nightly basis.

At a two-hour show cause hearing June 17 council members voted to suspend Allura’s business licence for three months.

Whether Allura, which operates out of Vancouver, needs a Whistler business licence to operate its Web service remains to be seen...

Enforcement of TA Bylaw Through Consent Order is Outrageous

RMOW staff are arbitrarily and unilaterally interpreting the bylaw when speaking to the public, whether by phone or in person. This results in misleading, inaccurate and inconsistent information being given out. The result is public confusion and perceived intimidation. RMOW staff are giving the storyline that now that a court decision has been made, that everyone has to fall into line. This is inaccurate and untrue. It is my understanding that the recent court decision has been appealed to the Supreme Court of Canada. Until Canada's top court makes a determination that particular case is undecided. Also, that case outcome has no legal relevance on the rights of any other property owner to dispute the bylaw, based on different facts and defenses. That is the way our society, rule of law, due process and justice system operates. RMOW staff, council and lawyer should be reminded of that obvious reality. This means recognizing and respecting the rights that every chalet owner and citizen has in law. That is, to challenge any law they feel is unjust or unenforceable, without fear of intimidation, sanctions, threats or punitive actions in the meantime....

Assert your Rights to TA Rentals

If you are in support of the right to rent out your chalet for TA purposes, and your property is not zoned for the purpose, don't be disheartened by this latest decision. It is just a mere bump in the road to rectifying the
injustice that currently exists on this TA issue at the present time in Whistler. It is important to understand the context, and your legal rights. That way you won't be intimidated if RMOW contacts you.

Disagree with Barratt's approach on Tourist Accommodation Dispute

My concern is that Barratt has obviously developed a mindset, that the end justifies the means. In other words, it is acceptable and financially more expedient, to trample on the rights of citizens to accomplish his end objective. This is scary stuff. This approach is rationalized by saying the RMOW will save money for other more worthy purposes by doing so. That is the logical extension of his argument. In other words, attempting to use his position to bypass or short-change due process of law and fairness, in order to force compliance on chalet owners who wish to assert their rights to challenge the bylaw. The recent TA court case only dealt with some very narrow points of law, and only applies to one specific property owner. It has no applicability on any other property owner. About 95% of the potential defences or arguments that an individual chalet owner could legitimately raise on the TA issue, have never been argued or tested in court.

Olympic Survey...

OLYMPIC SURVEY SHOWS WHAT BC REALLY THINKS

The 2010 Olympic Bid Corporation has its polls showing support for the Olympic bid, but opponents of the bid have their own polls painting a different picture.

According to a poll done for the Society Promoting Environmental Conservation, only 19.7 per cent of British Columbians are prepared to spend public funds on the Olympic Games.

The poll, conducted for SPEC by MacIntyre and Mustel Research between June 6 and 12, asked 506 British Columbians to rank environmental protection, health care, education, public transit, police services and the Olympics when it comes to allocating public money.

Spending for the Olympics rated last, behind transit, environmental protection, police and public safety, education and health care as spending priorities. SPEC says only 13.4 per cent of Vancouver residents listed the Olympics as a priority.

"The provincial and federal governments say we don’t have money to clean up Vancouver’s sewage system that pours 700 million litres of nearly raw sewage and toxic effluent into Vancouver Harbour and Georgia Strait every day," SPEC President David Cadman said in a release. "And we’re told there is no money for hospital beds or classrooms. Yet, the federal and provincial governments last week came up with $620 million for the Olympics."

"A lot more discussion needs to occur with British Columbians before millions of dollars are committed to a 14-day sports entertainment event."

STRATA HOTEL LAWS AND TAXES

The government currently taxes real hotels based on income instead of assessed property value, because the hotels don’t change hands often enough to determine what their market value is.  Strata hotels are taxed based on their property values, which are easier to determine as they are bought and sold regularly on the open market.

The problem is that the assessor applies the same mil-rate at $19.53 (dollar value out of $100 assessed value) to both real hotels and strata hotels, while strata rooms are valued higher. As a result, room for room, strata owners are paying higher taxes.  Furthermore, there are several properties acting as hotels that fall under the Class 1 assessment for residential properties, rather than Class 6 for Commercial properties, and are therefore assessed at a residential mil-rate that is around $7.

According to Craig East, who owns and rents units in the Whistler Village Inn and Suites, people who own units in strata hotels continue to be overtaxed in comparison to Whistler’s "real" hotel properties, despite the fact that these properties are run as hotels for the majority of the time.  East acknowledges that it’s a complex issue, and that the province is wary of changing a law that could result in existing properties and developers changing their status in order to pay lower taxes.

The Resort Municipality of Whistler has been involved with the issue since the beginning, and according to municipal revenue manager Jennifer Beresford, it’s been an uphill battle.  

"There are only so many things we can do to initiate change because the Assessment Act which determines how hotels are valued and classified is in provincial legislation – it’s not something that’s under the municipality’s control."

"There are a number of different ways this could be solved," Beresford said. "It could mean allowing the legislation to stay as it is but changing the definition and being more specific in what constitutes a hotel and what constitutes a residential property. The issue is really getting some clarity in the classification of properties and making sure it’s fair and equitable to everyone."

"The question comes down to who pays the rest of the property taxes," says Beresford. "It’s pretty hard to go back to the residents of Whistler that already have an incredible affordability problem that we are struggling to try and find solutions to, a lot of them working for average wages, and say ‘sorry, you have to pay more because commercial hoteliers want their taxes reduced’."

WORLD ECONOMIC FORUM IN WHISTLER

For any of you who followed the World Economic Forum (WEF) debate, here's the latest...  In an emotion-packed public forum at Millennium Place on April 22nd, a few dozen locals spoke to an audience of about 200 for and against the WEF hosting their January 2004 event in Whistler.

The outcome?  Whistler Council has offered to host the WEF, but on our terms.  A series of conditions were set in order to come to a compromise that will be less likely to offend WEF organizers, Gordon Campbell, and Jean Chretien than an outright "NO".  Included in the new invitation are conditions relating to the forum's dates, security, insurance, contents of the meeting agenda, and more.  Click here for details of the new terms.

LOTS OF SNOW AND SUN... AND GOLF!

This is getting to be routine, but the ski conditions are still unbelievable!  I've been up at least once per week over the past month.  Still record snow up top with the Peak and Harmony chairs running on Whistler during weekends.  Lift tickets are cheap and the sun and snow are really worth the effort.

Local golf courses are open, and although the snow is still amazing on the mountain, the golf courses are comparable to last June.  Squamish, Whistler, and Pemberton courses are all open with special deals for locals and BC residents.

For the mountain bikers out there, you may want to check out the latest offerings from the Whistler-Blackcomb Bike Park.  I've heard all my friends and neighbours raving about the extensive trails, jumps and birms... it may just be time to rent a full-suspension bike and give it a try.  The park is open! 

Check the forecast for the next sunny day, ski in the morning, and book a tee time for twilight...  you won't regret it.

SHORT TERM RENTALS -  ZONING APPEAL

A date has finally been set for the appeal of a B.C. Supreme Court decision upholding the municipality’s residential zoning bylaw and prohibiting short term rental of those homes.  The parties will appear in Vancouver at the B.C. Court of Appeal on May 28 at 10 a.m.

In 1999 the Resort Municipality of Whistler started 25 legal actions against owners of single family residential homes who were offering their places for short-term rental.  

A pair of Prince George dentists were the first to go to court.  The dentists argued that most of the people who used their home were friends and co-workers, but admitted to renting it out nightly for periods of less than 28 days.

The municipality hopes the case would set a precedent it could use to bring other so called illegitimate operators into line.

The original case was heard on Feb 17, 2000, but it took B.C. Supreme Court Justice Ian Drost until Jan 15, 2001 to hand down his decision upholding the municipality’s position.  It has taken another year, until this week, for the appeal date to be set.

In a previous interview the lawyer for the dentists, Jonathan Baker, said he expects a decision to be handed down about a month after the appeal hearing.

Theft on the Rise...

RCMP ISSUES THEFT WARNING AFTER INCIDENT

Don’t leave valuables in cars when hiking and biking

When the snow clears it’s natural to load up the car with your gear and head for the hills. However, the RCMP are cautioning hikers and mountain bikers to be careful about what they leave behind.

One 19-year-old Whistler resident returned to her vehicle at the Cheakamus Trail entrance and as she approached a male fled in a new model, black Ford with stolen B.C. plates, number NDD 078, and validation sticker.

The suspect had stolen the victim’s purse, and while heading southbound on the highway he dumped most of the contents onto the highway. She estimates that approximately $60 was taken.

Editor's note: ResortAc.com has also received reports of personal items being stolen from balconies (2nd story) and from private property.  Personally, I have also noticed many instances of broken windows at local bus shelters, graffiti all over town, and other acts of vandalism.  Ugly events that used to be rare are occurring in Whistler on a regular basis now.

We've recommended this in previous newsletters, but it appears very few of you have listened.  We suggest taking a few minutes to look at the wording of your "Property Name" and "Short Description".  These two simple items create your first impression to potential renters who visit our website.

Put yourself into a vacationer's shoes... which features of your rental home are most important to them?  Which features does your place offer?  Key into those features and make sure to include them in your listing.  For example, private hot tub, drive-to-your-door, amazing views, quiet location, large yard, pet friendly, etc.

Smoking...

SMOKING REGULATIONS NOT GOOD ENOUGH FOR WHISTLER

For the second time in five years the regional medical health officer has asked council for a no-smoking bylaw for the hospitality industry in the resort.

"It's unfortunate that I have to come back to you," said Dr. Paul Martiquet at Monday's council meeting, but he said the current provincial regulations are just not good enough for a place like Whistler.

The hospitality staff at the resort deserves more, the residents deserve more and certainly the tourists are looking for more when they come to a world class resort like Whistler, Martiquet said.

His main concern is the effects of second-hand smoke.

While Martiquet praised the resort for encouraging voluntary non-smoking rules, he said it's not enough.

"It's really positive that pubs are going non-smoking voluntarily. It shows that Whistler is a healthy place to live. But it should be a level playing field. It should be a consistent application, not just voluntary."

His request to council comes at a critical time in the history of smoking regulations in B.C.

As of this month the Liberal government passed regulations that once again allow smoking in licensed establishments, provided local bylaws do not prohibit smoking inside a building.

Under these new regulations bars and restaurants can construct separate smoking rooms which must be ventilated outside or through a ventilation system.

Zoning...

FUNCTION OFFICE SPACE BEING LEGALIZED

All second-floor office space in the south end of Function Junction will become "legal" when a zoning amendment is adopted in the next few weeks.

The amendment, which was given first and second reading Monday, will change the IS1 zone to permit many existing businesses in Function Junction, such as accounting offices, lawyers offices, property management companies, travel agents, administrative offices and community and business services. Those businesses, on Millar Creek Road and Alpha Lake Road south of the cement plant, are not permitted under the current zoning, even though the municipality has issued business licences for those businesses.

CREEKSIDE PETROCAN GAS SEEPAGE

A good friend of mine bought a home in the newly developed Beaver Flats area in Whistler's Creekside.  She was shocked to find that she may be living in an environmentally toxic area... and so were her neighbours.  

Up until now, only a select few were privy to the details of the Petro-Canada gas station's leaky tanks; however, it is now public how this contaminated soil is hampering Intrawest's Creekside development plans.

Intrawest's plans include a highway underpass for the Valley Trail and an underground parking facility in the Creekside area where gas has leaked into the soil.  Intrawest has also delayed plans for the final realignment of Whistler Creek.  

Whistler's Municipal Staff are estimating that the cleanup could take up to 5 years.  It has not been announced who will pay for the environmental cleanup.

Had my first nightmare guest in 7 years. You may want to pass this on to other owners that if they rent to a Mr. James Howe from Manilla that they ensure they get a large damage deposit, to cover surface damage to furniture and enough to cover 16 hours of cleaning.

I have never been so disgusted in my life with the filth left behind, that I do not want anyone else to endure what I had to deal with.

TA ZONING - THE "CONSENT ORDER" FOR WHISTLER PLATINUM

We're still feeling the tension in the air with regard to Whistler's TA zoning issue.  We had a run-in with a TA zoned home owner this week.  He's refusing to pay his last 6 month's listing fees because, he alleges, we do business with illegal rentals.  He furthered his justification for not paying me by saying that he's done his research and discovered that he's losing business to improperly zoned rental homes.  This seems to be the latest stand taken by owners of TA zoned homes... "we'll have nothing to do with all you law breakers out there".  It sure takes all kinds of people to make the world go 'round.

If you're new to this debate, I'd recommend reading our previous newsletters right away to get a feel for both legal stances.

At the March 4th Council meeting we heard Bill Barratt reading legal statements from Whistler's lawyers, regarding the crackdown on Whistler Platinum.  www.WhistlerPlatinum.com offers both short and long term rental accommodation.  Apparently the Municipal bylaw enforcers have decided that the long-term rentals need to have their own website, according to information presented in March 14th Whistler Question. 

David Burke's Question article goes on to explain that the Municipality's crackdown is being called a "groundbreaking agreement" by Whistler Platinum's legal counsel. This was the latest step in a legal ping-pong match between the Muni and Whistler Platinum.  A little background:

  1. Whistler Platinum receives written cease and desist order to stop doing short term rentals in non TA zoned homes.
  2. Pressure was applied by Whistler's lawyers by threatening to pull Whistler Platinum's business license.
  3. At the March 4th Council meeting Bill Barratt informed those of us in attendance that Whistler's Lawyers decided to alter that plan and go instead for criminal charges; charges of contempt of court for ignoring the cease and desist order.
  4. Whistler and Whistler Platinum agree to sign the "Consent Order".

Ian Davis, Whistler Platinum's lawyer, stated in the Question that the operator had only 2 properties that were not TA zoned out of a total of 30 homes.  He said the "Order" requires the company to advertise short term rentals on a different page than long term rentals.  Tom Barratt was quoted in the same article that Whistler Platinum were "cooperative" in reaching an agreement.

 

Democracy in Action...

WORLD ECONOMIC FORUM PETITION

Also from March 4th Council meeting, the delayed vote for whether or not to invite the World Economic Forum (WEF) to Whistler.  If the WEF comes to town, their meetings will occur during the 3rd week of January, 2004.

Recap of events:

  1. WEF researches move from New York, 2002, and Davos Switzerland for the 30 years prior to that.
  2. Meetings about Whistler hosting the WEF have been taking place for over a year.

  3. Those meetings have been attended by local politicians, Premier Campbell, the Prime Minister’s Office, Federal Ministers, and members of the business community. 

  4. Whistler Council did not debate the issue before the public until March 4, 2002.

  5. At that first public debate, certain members of Council moved to invite the WEF to Whistler without delay, which would have prevented any opportunity for further public input.

  6. Mayor and Council explained that this secrecy was at the request of the WEF “out of consideration for the town of Davos and the Swiss government.” 

Well, I've done my homework and feel very strongly that this is not a good thing for Whistler.  High-security, political conferences in the middle of ski season do not fit well with Whistler's brand. Not to mention the fact that our Mayor and Council seem to be more worried about offending Premier Campbell and the Davos Officials than they are about offending Whistler locals.

A petition opposing the WEF meetings in Whistler has been created.  The first stack of over 900 names was registered with the Whistler Municipality.  They were included in the April 2nd Council meeting, along with about 20 letters from local residents.  If you have an opinion on this one, you really should let Whistler's Mayor and Council know.

At the Council meeting Tuesday night, the Mayor announced that community input was significant and he explained that the decision to invite the WEF to Whistler will be delayed yet again.  Further, he explained, there will now be a special meeting on April 22nd to deal with this controversial issue.  We'll have to wait and see who really determines Whistler's future... big business and government or the community of people who built this amazing resort.

After spending the Thursday and Saturday mornings in boot-top silky powder, I'll tell you that the conditions are epic for this time of year.  Cooler temps, bright sunshine and fresh snow all the way to the valley.  Get your butts up here for what may be the end of the top-to-bottom-cruisers for this season.  Compliments to Whistler-Blackcomb for really pulling up their socks in the grooming department over the past couple months.  Nice work guys.

Water...

MAJOR SHOT OF CHLORINE IN WHISTLER WATER

After my wife and I noticed a really strong chlorine smell while bathing our baby, we decided to check out why.  Whistler's Municipal Staff were quick to offer some details of why we were noticing an increase in chlorine in our water.  It was because there has been a dramatic increase in the amount of chlorine added to our water... go figure.

Turns out that, after the major inquiry into BC's drinking water, Provincial Government authorities decided that all municipal water supplies needed to meet minimum chlorine standards.  They say that it is for our own protection.  You see, since the Walkerton Ontario deaths from contaminated water, BC's health authorities want to make sure that they don't expose their legal butts.

I'm not sure if it's any use, but anyone who has an interest in this may want to write a letter to the papers or contact the Government officials to see if we have any choice in this decision.  After all, we have some of the cleanest water in Canada here in Whistler.  Do we really need to ingest toxic chlorine because the water in Ontario is contaminated?

TA ZONING - THE OTHER SIDE OF THE STORY

Well, let me start by saying this is one heated debate!  We received emails from a few very angry Whistler home owners after last month's story about the Municipality's "crackdown".  In order to balance our coverage of this important legal issue, we'd like to share with you a legal perspective from a Vancouver lawyer who is currently involved in the Whistler v. Miller appeal.  If you have questions about the current bylaw and how it is enforced, please read every detail of this letter...  it's long, but it's good.

 

Letter from a lawyer...

When the Resort Municipality of Whistler was established in the early eighties, planners were concerned that there would not be enough tourists. It was feared that housing would be bought by rich foreigners who would never rent and that as a result there might not be enough residents to support the commercial businesses. The Municipality addressed this concern when the town centre was developed by requiring through covenants registered on title that dwelling units be placed in a rental pool so that they would always be occupied.

Whistler, however, proved to be an instant success and the policy of the City changed. People who bought houses in single family dwelling areas and who rented them out for short term stays, soon found themselves under attack by the Resort for being in violation of the single family zoning.

A Municipality can enforce its zoning in two ways: It may if it wants, prosecute the owner of a dwelling for violation of the bylaw. This procedure takes place in a Provincial court. The process is like traffic court and the owner, if convicted, faces a fine which may be relatively modest. Each day the violation continues, however, constitutes a new offence so that the City can charge a person for a series of violations and in this way greatly increase the amount of the fine.

The second procedure, - one being followed by Whistler - is to apply to the Supreme Court of British Columbia for an injunction to order the owner to stop renting his house for short term accommodation. If the owner defies the court order he is in contempt of court and risks a substantial fine or jail.

Whistler decided to proceed against owners in single family areas who rent their dwellings for short periods of time i.e. under one month. Whistler v. Miller was precisely such a case. We were retained by the defendants. Their House is in a Single Family Residential (RS 1) zone. That zone permits two relevant uses: (1) detached dwelling, and (2) auxiliary use. The legal question is whether under this scheme a home owner may occasionally rent his house for short term stays as an auxiliary use?

We argued that the short term rental of a house was an auxiliary use. The primary use was detached dwelling and since our clients only used the house for short term stays for a very small percentage of the year it could not reasonably be deemed to be anything but an auxiliary use.

The court held however, that since the words “tourist accommodation” and “temporary tourist accommodation” were expressly allowed in other zones, but not in the RS single family zone it was by implication excluded from the words “auxiliary use”.

That decision has been appealed to the British Columbia Court of Appeal and will be heard in late May.

If the Miller’s win, then owners of homes in RS areas will be allowed to rent their homes for short stays. This does not mean that they can have multiple units in the homes nor does it mean that they could rent them for short stays for most of the year. Any limits to the use will be decided by the Court.

Until the appeal is heard, the law is today as determined by the lower court judge. One may not rent a single family dwelling for periods of less than thirty days.

If a person is in violation of the bylaw, the City will have to prove that fact. They may use evidence such as advertising on the Net but would probably require further evidence of actual rentals. The owners would receive first a letter directing them to stop what they are doing. If they continue they would receive Court Documents ordering them to appear in Court. Whether they would have a defence would depend on the facts and circumstances. In all cases it would be advisable to retain a lawyer because in many instances the municipality may not have admissible evidence to prove its case.

Garbage...

WHISTLER GARBAGE — 50% REDUCTION TARGET ACHIEVED?

In 1990 the province asked BC communities to reduce their 1.2 tonnes of waste per person by 50 percent by the year 2001.  According to the Pique, Whistler has achieved this goal.  Don't get too excited though, the Muni released their numbers from 2000 revealing that 18,433 metric tonnes of material was disposed of in our landfill (an increase of 16% over the year before).  This equals 755 Kilograms or about 1600 pounds per resident.  Clearly, Whistler still has a very large environmental footprint.

The Natural Step Framework (delivered to Whistler residents this week) has a printed goal of reducing our waste from 755 down to 400 Kilograms (about 880 pounds) per resident.  This seems to conflict with Whistler's recently announced plans to host the World Economic Forum and, of course, the 2010 Olympics.  Looks to me like some of our decision makers in City Hall haven't done the math.

$1 MILLION DOLLAR WEBSITE FOR WHISTLER MUNICIPALITY

OK, I'm sorry to say that my "news" letter is becoming an easy method of venting on Whistler's councillors; however, the decision to spend close to $1 million on a website can't slip through without some serious criticism.  I'll give you the short version below:

 
  • $143,000 already spent:
    strategy, needs assessment, detailed design
 
  • $700,000 planned for software, hardware, training and content 
 
  • $plus, plus, plus

This quote from the Pique really scares me, 
"Sooner or later we're going to have to have a transactional Web site and it's not going to get any less expensive down the road." 
said Diana Waltmann, information officer with the municipality.

Anyone who has ever priced computers, software, website, or e-commerce related items knows that this comment is just not accurate.  In addition, the planned platform is Novell.  That's right, Novell.  We have done some looking around to see if Novell has any other municipal websites up and running, but so far we're coming up empty.  Can't help but wonder why Whistler would choose the Novell platform, especially at such a high price tag... another example of your tax dollars at work!

WHISTLER WOOS WORLD ECONOMIC FORUM (WEF)

"Last month in New York, the WEF met at the Waldorf-Astoria. Security consisted, for openers, of concrete barricades sealing off nine square blocks around the Waldorf. Nine square blocks in Manhattan is somewhat larger than what we generally think of as ALL OF WHISTLER.  That was for openers. There were also police: 3,800 of them! Armed with machine guns. There were bomb-sniffing dogs. There were US Secret Service agents. There were US Air Force fighter jets protecting the airspace."

Generally speaking, I'm not an alarmist; however, it's pretty hard not to be concerned about an event like WEF taking place in my hometown.  I'm not alone.  Several senior business people in Whistler have publicly commented about our current Council and Tourism Whistler's direction lately.  These types of events may look great on the conference sales projections, but that's really the only place they look good.

Whistler has been painstakingly designed and "branded" as a peaceful mountain hideaway with all the comforts of the big city...  and none (or very few) big-city problems.  Why on earth would we intentionally change our marketing formula?  The current formula has provided unprecedented growth thru numerous world economic cycles.  Take a minute and reflect on the characteristics of Whistler that coax  you to return year after year and to invest here.

In the words of Scott Carrell ( a prominent Whistler business owner and one of Intrawest's original visionaries) in a letter to our community leaders,
"The world does not need to see  our town in this light as it will cause irreversible damage to the brand we spent well over 20 years building.  If this is how you justify the conference centre renovation then we are well on the way to a massive community sell out for your Olympic dream... Don't sell us out."

MUNI SET TO ENFORCE CLAMPDOWN - TA ZONING

The word on the street is that Whistler council has authorized its enforcement personnel to clamp down on illegal tourism accommodation (TA) operators.  TA operators act as property managers for several privately-owned houses that are typically rented by the night or the week to Whistler visitors.

At a December property manager's meeting attended by Tourism Whistler, the Muni, and others, the reason given for the clampdown is that these operators are not licensed as bed and breakfast businesses, do not pay taxes, they are not regulated for fire safety and other hazards associated with commercial rentals and they often do not collect GST tax. The tax issue raises the ire of legal operators since not paying GST tax allows these operators the ability to charge 7 per cent less rental fee. 

It is illegal to rent unlicensed accommodations for fewer than 28 days, according to the zoning bylaws. The Muni won the first court case last year; however, the defendants have appealed the decision. The results of the appeal may not be heard for months.

You are likely asking what Municipal Hall intends to do. According to Bill Barratt, GM of Community Services, they plan send letters to all illegal TA operators in early January informing them that they must "cease and desist". If the documents are signed and the illegal renting stops, there will not be any charges. If the letters are ignored, criminal charges may follow.

Inside sources say that at least one private investigator has been hired to track down unlicensed property managers and proceed with the legal process. We have heard of 3 letters being delivered to such operators. In all 3 cases, the accused were RENTING MULTIPLE improperly zoned homes as a full-fledged business.

So far, there have been no reports of letters being delivered to individual home owners who occasionally rent out their Whistler homes.

Rich & Famous...

WHISTLER — ANOTHER ASPEN?

Whistler, it seems, has been discovered by more than just the powder set. Now it’s the jet set that’s calling this ski town their home away from home.  It isn’t unusual to see stars from the screen or athletics strolling through the village, sampling the fine restaurants or speeding down the slopes here.

And, the reason they’ve chosen our little town is simple. Whistler offers privacy and beauty and some of the best skiing in the world.  
“If you want Beverly Hills on ice then go to Aspen,” says British pop star Seal who actually owns a home in Whistler. “But it’s great people and a fantastic environment that keeps me here.”  And, despite the growing numbers of rich and famous visiting the village, there aren’t the common groupies or paparazzi following them.

Tourism Whistler’s attitude towards the influx of celebrities is the ‘more the merrier’. The stars are often treated to everything Whistler has to offer in exchange for allowing the resort to publicize their visits.  Among those who have been seen here are: Britney Spears, Tony Curtis, Goldie Hawn, Bill Gates, Courteney Cox, Alicia Silverstone, Geri Halliwell and Brad Pitt.

 
Big Snow Year...

RECORD SNOWFALL FOR WHISTLER’S EARLY SEASON

December’s snowfall almost hit record levels when Whistler was hit with huge snowfalls three Saturdays in a row.  By Dec. 18 the measured accumulation was 358 centimetres or 141 inches of snow. In the seven days leading up to Dec. 18 Whistler-Blackcomb received 198 centimetres of snow or 78 inches and the settled base exceeded two meters in most places.

Environment Canada and the Farmer's Almanac are calling for a very big snowfall season; however, the big snow trend from December has all but vanished. The current alpine base is still huge and above-treeline conditions are epic; however, 10 days of warm rainy weather in early January have taken their toll on the lower mountain.

We are still seeing fresh powdies up top on a firm base and great top-to-bottom groomed cruisers; however, the steeper sections near the base of both mountains are showing exposed rocks and twigs. The past 2 days have provided clear and cold weather, permitting Whistler-Blackcomb to fire up the snow cannons.

All in all both mountains are in great shape.  If you are considering coming up for some turns, I'd recommend going up early to catch the groomed corduroy.

 
Culture...

CULTURAL CENTRE ANNOUNCED FOR WHISTLER

An announcement was made in early December of plans to build a cultural tourism facility in Whistler’s Upper Village.

The Squamish and Lil’wat Nations plan to develop a five-acre cultural centre that could include a First Nations traditional village, interpretive trails and ceremonial gathering area. The site will most likely be the wooded area across Blackcomb Way from Intrawest Resort Club and the Glacier Lodge at the base of Blackcomb Mountain.

The Honourable Robert Nault, Minister of Indian Affairs and Northern Development says the project will enhance Whistler as a destination point and contribute to the enhancement of the Vancouver Olympic bid. He said a strong partnership with First Nations is essential to a successful bid.
 
Vancouver Olympics...

WHISTLER NAME DROPPED FROM OLYMPIC BID

The bid for the 2010 Olympics is no longer the Whistler 2010 Vancouver/Whistler Olympic bid — it’s now just the Vancouver Olympic Bid.  
According to International Olympic Committee (IOC) rules — specifically rule No. 37, only one name can be used to describe an Olympic host and it must be where the openning and closing ceremonies are held.

Nester's...

NESTERS MARKET UNDERGOES EXPANSION

One of Whistler’s landmarks has undergone a facelift. Nesters Market, a local shopping centre since 1987 is now bigger and better than ever.  Extensive renovations during the past year have transformed the corner store into a full-services supermarket. 
The new store has a bakery, a specialty  meats counter, an expanded deli as well as a live fish tank with lobster and crab. The back of the store has more than doubled—jumping from 6,000 to 13,000 square feet.

To thank customers for the inconvenience of shopping around hammering, torn-out shelves and confusing aisles, the store offered customers a week-long promotion of specials and give-aways. Nesters now has wider aisles and more overall product selection, including an expanded organic section.
 
Increase Bookings...

PHOTOS DRIVE BOOKINGS AND REDUCE ADMIN WORK

Try a little marketing experiment with me. Pretend you are a potential vacation home renter and go look at a few rental home listings on www.ResortAc.com (just click the search link, upper left). Compare the listings with nice photos to the ones without any photos.

Now pause and think for a moment... if you were going to write a vacation rental check for $1500 and mail it away, would you feel better about sending it to the owners of the rental home with photos or the one without?

If you say it doesn't really matter, you'd better think again! I'm sure you'll agree that the place without the photos COULD be just as nice; however, you would certainly want to call or email the owners with a few important questions prior to mailing your rental payment. Those few questions can quickly turn into a 2 page email or a very long phone call. 

It is true that a photo is worth a thousand words, especially in the Internet world where every renter fears being ripped off. We receive numerous phone calls and emails from wary renters from around the world wondering whether a particular rental home is legitimate. If the listing does not have photos, the question always arises... why not?

So we pose the question back to you... if your listing does not have photos, why not?

With digital technology the easiest option is to use a digital camera. The next best choice is scanning of traditional photos, either at home or at a copy center like Kinko's. We offer digital photography services for CDN$99. We will come to you home, shoot about 20 photos, select the best ones and post them to your www.ResortAc.com listing. WINTER TO DO LIST FOR OWNERS

The following is a list of tips for owners to help prepare their units for the winter season.

HEAT:
With the onset of winter there are actions that owners can take to protect their personal property.

· secure all windows, doors if you are leaving for an extended period of time
· ensure garage doors are closed at all times if there are sprinkler heads inside
· set your thermostat to a minimum of 15 degrees Celsius if your unit is vacant for more than 24 hours

SNOW REMOVAL:
Residents can assist in keeping the roadways and parking areas clear of snow by moving their vehicles at least every 24 hours. Inoperable, uninsured vehicles stored in common property should be towed if they are obstructing the snow removal equipment.

WATER LINES:
Remove all garden hoses to storage. Any hoses still attached to the hose bib may result in a freeze in the line. Shut off main water supply lines and drain reservoirs.

SECURITY:
There are ways to protect both yourself and your property. Ensure all doors and windows in your unit are locked.
· Do not duplicate keys
· Watch the garage door close behind you
· Report any suspicious activities to a security company or the RCMP.

BIG SNOW – NO MARKETING HYPE

In case you did not hear… it really has been an epic season up here so far. From the high alpine all the way to the village, we have great coverage and light fluffy powder. I have been up 6 days so far this season, each of which was blessed with deep powder and short lift lines.

 

Web traffic...

PAY-PER-CLICK SEARCH ENGINES

You may have heard this term and wondered what the heck it means. Well, this is the latest trend in Internet advertising. Any website that wants traffic now has to pay to play.

Pay-per-clicks sell off top spots for keywords to the highest bidders. For example, “whistler accommodation” is going for US$1.82 per click on www.Overture.com (formerly Goto.com). This means that every potential customer who finds the top listing on the search (and clicks on it) will cost that advertiser US$1.82.

There are roughly a dozen pay-per-click search engines out there now, each with their own rules. All the busy ones are commanding higher prices per click, with each passing month, as their popularity grows.

If you are wondering if www.ResortAc.com pays to play, we sure do! We have been purchasing keywords on all the pay-per-clicks we can find for the past 6 months.  Our work with the pay-per-clicks and the other search engines is paying off with the highest traffic we've ever had... over 500 user sessions per day (average over past 30 days).

PAY ATTENTION TO WORDING

Well, your vacation rental listing is up and running on www.ResortAc.com and you are wondering what to do next.  We suggest taking a few minutes to look at the wording of your "Property Name" and "Short Description".  These two simple items create your first impression to potential renters who visit our website and do a listing search.

Put yourself into a vacationer's shoes... which features of your rental home are most important to them?  Which features does your place offer?  Key into those features and make sure to include them in your listing.  

Our technology is great for getting potential renters to our website, but every little bit you do helps to get those extra bookings.

 

Insurance...

NIGHTLY RENTAL INSURANCE

Before your first overnight guest walks through the door it's a good idea to make certain you and the renter have agreed upon a liability waiver.

Anyone who rents their house or property should draw up a liability waiver that will hold the renter responsible in the event of any damage.

Sea to Sky Insurance in Whistler says that insurance policies for nightly rental houses and condominiums can be double or even triple the normal rate. 

The owners of a nightly rental home listed as worth about $800,000 in Whistler pay $5,500 in insurance per year. If that same house was not rented the homeowner's insurance would be half or less than half that amount.

And the insurance will only cover your house in the event of fire or water damage, wind storms or break-ins from unknown people. Nightly rental homes are considered extremely high risks by insurance companies thus the high premiums.

Most property management companies recommend taking other precautions before each rental. First, have the guest sign a waiver that holds them responsible for any damage that occurs while they are occupying the premises. Second, take a credit card imprint and a signature from the renter that agrees that any damages can be claimed on the credit card.

It is always a good idea to take a damage deposit that is held in trust until the renters have vacated the unit and an inspection has been made. Cleaning companies will assist you and generally will keep an inventory of the contents of your unit.  Damage deposits can run as high as $5,000 depending on the value of the contents and the house. Usually, however, they are significantly less.

Most property management companies agree the best defence against theft and damage is to screen as well as possible the clients renting your home. Many say they will not rent to anyone under the age of 25 years old.

 

Whistler Creek...

CHANGES SET FOR CREEKSIDE

More changes are in store for Creekside. Council voted last month to go ahead with an application by Husky Oil to rebuild its gas station.

Husky Oil will demolish its existing facility some time next year and rebuild a 3,440 square foot retail/convenience store operation on the site. The car repair facility will be eliminated, three gas pump islands will be built and a touchless car wash will be added.

Nearby Lake Placid Road will also see some changes. Council voted to okay a plan to put electrical and telephone wires underground on that road as well as create curb and gutters on the north side as well as a sidewalk from the train station to the highway on the north side of Lake Placid Road. 

There will also be new ornamental sidewalk lighting, new pavement, a storm water collection and treatment system, new water and sewer piping.

 

Cutbacks...

INTRAWEST CUTS STAFFING BACK

Whistler and Blackcomb mountains won't be fully staffed until late in December, says Intrawest's chief financial officer and executive vice president.

Dan Jarvis says the company plans to keep costs down by keeping staffing very tight until the Christmas season. Normally both mountains are fully staffed by the U.S. Thanksgiving weekend. 

Jarvis says year-round staff and management are committed to filling in where necessary to make certain guest experience isn't compromised. 

Whistler-Blackcomb has hired 200 fewer first-year employees this year and their start dates were staggered up to the start of Christmas holidays.

A change in marketing strategy by Tourism Whistler and Intrawest has placed more focus on selling the resort to skiers able to drive here.

 

Good trend...

SKIING/SNOWBOARDING GAINING POPULARITY

The President of the Canadian Ski Council says more Canadians are skiing and snowboarding than ever before.

In a report released this month, the council reported an overall 2.2 per cent increase in the skier/snowboarder volume in 2000-01 over the previous year. Numbers grew from 17.4 million to 17.8 million.

Collin Chedore, council president said an incredible snow season in eastern Canada helps explain the increase in that part of the country. Ontario, which received record snowfalls last year, saw an increase of 18.7 per cent. In western Canada, where snowfalls were meager, numbers were down. Alberta dropped 25.5 percent and B.C. and the Yukon dropped 11.5 per cent.

 

Spare food?

WHISTLER FOOD BANK NEEDS YOUR HELP

Food banks in Whistler are bracing themselves for increased demand for emergency food this fall.

High numbers of seasonal workers, unable to begin their jobs until December are barely making ends meet. On the first day it opened this month record numbers of people showed up at the food bank to pick up things like pasta, spaghetti sauce and bread.

Sandra McCarthy, food bank coordinator, says canned and non-perishable food items are desperately needed. To make a donation you can use the drop-off boxes at Nesters, IGA and The Grocery Store.

 

What's new?

WHAT'S NEW ON WHISTLER/BLACKCOMB THIS YEAR

Whistler/Blackcomb continues to amaze its patrons each year by continually refining and adding to what is already the #1 ski resort in the world. This year won't be any different.

New to the mountain this season is the new Super Park in the Nintendo GameCube Terrain Park. Located on Blackcomb, this controlled park offers the biggest hits on the mountain, catering specifically to the advanced and expert skiers and snowboarders.

The Super Park is divided into two parts -- the left side for experts and the right for advanced users. There are two 'hike a rail' sections seperate from the jumps to provide jibbing and jumping . The rails and jibs in the park are the most difficult in the park and feature big tabletops, hips, spines and more.

Whistler mountain is now home to the resort's first 'family zone' in Green Acres, off the Emerald Express. The 'Family Zone' features a large slow-skiing/riding area of the mountain -- ideal for families and for first warm-up runs.

Both mountains were busy in the summer widening and shaping ski-outs and terrain. Snow-making around the Olympic area was expanded and substantial summer grooming and snow fencing was added to ensure some of the best early conditions in Canada.

Whistler/Blackcomb offers the longest ski season in North America. Both mountains will be until April 21,2002 for Blackcomb and June 9,2002 for Whistler. Blackcomb reopens June 10 until August 4,2002 for summer glacier skiing.

Zoning appeal...


 

WHISTLER RENTERS CONCERNED ABOUT APPEAL DELAY

Legitimate rental operators in Whistler are concerned that the delay in the decision by an appeal court ruling which would crack down on companies and homeowners renting their places in contravention of the municipal bylaws will affect their businesses this season.

The municipality started 25 legal actions against 'illegal' operators in 1999. The appeal has been delayed until 2002 at the earliest and the bylaw and municipality department admits their hands are tied.

Businesses who operate as legal rental accommodation in Whistler are worried that people making bookings to come here will opt to use illegal operators because they can offer lower rates and no taxes.

Operator Lina Jacobs of Whistler Home Holidays says she is being penalized and may lose her businesses because the municipality is unable to shut down illegal operators at this time. She says she became a 'legal' operator only four years ago when she applied to rezone her properties. She sold homes that were not zoned for nightly rentals and spent 'millions' on houses that were.

Jacobs says she has been notified by many guests thanking her for the great service but saying they had booked other accommodation that offered lower prices.  She said she can't offer the same prices as illegal operators and there's no way that she's going to give up "my homes, the business and family income to these operators."

 

Cleaning your drawers?

HOW TO HIRE A CLEANING COMPANY

Finding the right cleaning company for your business may be one of the most important factors in having a successful season. In Whistler there are many to choose from but there may only be one that will give you what you need.

"Ask for references," says Kim Lund, owner of Contract Cleaners Ltd., a company that's been involved in nightly rental market for 16 years. "The best way to gauge how a company cleans and operates is to ask someone who has used them for a while."

Ms Lund says homeowners should ask the cleaning company several important questions when making a decision. First, she says, it's important to hire a company that is bonded and carries the appropriate insurance. Second, ask how long they've been in business.  "The last thing you want is to lose your company in the middle of the season," says Lund.

Also, make certain the guidelines are clear. That means find out about check-in and check out times, inventories, laundry costs and cleaning supplies. Homeowners should ideally provide a lock-off where linen and cleaning supplies are kept. Be certain you are clear about prices and remember, "other factors should be taken into account as well as the price," says Lund.

Lund also said your cleaning company should be expected to clean cupboards, drawers, fridge and stove as well as vacuuming, dusting, bathrooms and kitchen. They should take out the garbage, put in new supplies, pull down the blinds and turn the lights off. Additional expectations should be spelt out clearly in a contract between owner and the cleaning company.

Survey Results...

MARKETING FOCUS SHIFT FOR TOURISM WHISTLER

Tourism Whistler has shifted its marketing focus this season in light of the events of September 11 and recent survey results conducted throughout the U.S. 

Plans to launch an advertising campaign in New York this fall have been changed to a marketing plan geared to other regions. The plan to draw tourists from the New York area has been redirected to skiers in the B.C.-Washington, San Francisco-West Coast, Toronto, U.K., and Australia markets.

Tourism Whistler's survey was conducted in New York, Chicago, San Francisco, Seattle and Toronto. Of the 700 skiers canvassed, 91 per cent said they were planning a holiday this winter but only 22 per cent said they were planning to holiday in Canada. Of those planning to come to Canada about 70 per cent were from Toronto. Seattle was the next largest market.

When asked if they had changed their holiday plans following Sept. 11 attack on the U.S., 50 per cent said they had postponed their bookings, 23 per cent said they would be taking shorter holidays and only 16 per cent said they had cancelled their trips.

Other interesting survey findings:
  • 24 per cent did not want to cross the border;
  • one-third said they were concerned about air-travel;
  • 27 per cent were concerned about safety at the destination;
  • 31 per cent said they had financial concerns;
  • only nine per cent said they would not travel this season;

Not surprisingly, what mattered most to New Yorkers in choosing a holiday destination was safety, while cost was most important to those from Toronto. San Francisco wanted value for their dollar and Washington State was looking for good snow as well as good value.  Officials at Tourism Whistler said the most important news coming from the survey was that only 20 per cent of those surveyed in Washington State expressed concern about traveling across the border.

The marketing lineup for the next few months will be first to blitz the Lower Mainland, then Seattle, San Francisco, Australia and the U.K. In January the focus will shift to Portland and in February, Toronto.

 

$19 Million lots...

REAL ESTATE MARKET STILL STRONG IN WHISTLER

Homes and condominiums are still selling in Whistler in spite of a slowdown in the economy and the war on terrorism in the U.S.  Pat Kelly, president of the Whistler Real Estate Company, says there's no doubt sales are down but that is more likely linked to the poor economy rather than a panic among consumers to pull out of real estate. "We don't have panic selling by our American owners who are afraid to cross the border, but it may not happen until the ski season starts next month," said Kelly.

Meanwhile Intrawest's plans for the new Four Seasons development are right on track. Paul Woodward, vice-president of Intrawest's Resort Development Group in Whistler says "we will be going to market with that in early spring." He also said response to the new Kadenwoods, formerly known as the Peaks, has been very positive. Most of the $19-million lots are expected to go quickly.

WHISTLER VOTED BEST SKI RESORT

Whistler has been voted Best Ski Resort in the world by readers of the Daily Telegraph Newspaper in Great Britain.  The award is based on a travel survey response from the Telegraph's readers ranking everything from airlines to travel websites.  This is the second award for Whistler this fall—it was also awarded the 2002 North American Ski Resort of the Year award by editors of the Good Skiing and Snowboarding Guide in September.

 

Jobs...

FEWER STAFF HIRED AT MOUNTAINS

Whistler and Blackcomb Mountains will hire fewer staff this year and will stagger the start dates of the new staff.  This year the mountains will hire about 1000 staff compared to 1200 in 2000. The jobs will be staggered so not all employees start when the mountains open on November 22.  Recruiting Manager Karen Bauckham said the drop in the number of positions is the direct result of concerns about security and world economics. The events of September 11 in the U.S. have left tourist operators only guessing how people will react in terms of their travel plans.
